This section directs the Secretary of the Interior to take into trust for the Barona Group of Capitan Grande Band of Mission Indians approximately 836 acres of covered land—Parcel 1 (~160 acres of Bureau of Land Management land), Parcel 2 (~160 acres), and Parcel 3 (~516.21 acres)—and transfers administrative jurisdiction over Parcels 2 and 3 to the Secretary, subject to valid existing rights. The trust land becomes part of the tribe's reservation and is administered under laws and regulations generally applicable to federal Indian trust property, subject to (1) continuing public access for recreational, scenic, scientific, and conservation uses (including motorized roads and trails); (2) rights-of-way for Bureau of Land Management and Forest Service emergency access; and (3) prohibition on class II or III gaming under the Indian Gaming Regulatory Act. Nothing in this section affects existing water rights or service agreements.
