H.R. 8488 — AI Data Center Site Selection Transparency Act of 2026

This section requires covered entities intending to establish, operate, or own an AI-focused data center to disclose the proposed location, estimated resources needed, and environmental impact to relevant local elected officials and the public in a press release no later than 180 days before taking a definitive step to establish the center. The section further mandates public outreach through engagement with local media, social media posts, direct mail notices, physical signage, and materials in English, Spanish, and other commonly spoken languages in the affected area; limits the use of non-disclosure agreements; prohibits NDAs with government entities or regarding public resources; and requires an independent third-party environmental impact analysis funded by the developer. Multiple covered entities must issue a single joint disclosure, and each remains jointly and severally liable for compliance. Violations are treated as unfair or deceptive acts or practices enforceable by the Federal Trade Commission under the Federal Trade Commission Act.
