H.R. 849 — No Regulation Through Litigation Act of 2025

This section prohibits the head of a federal agency from entering a consent decree that exceeds the authority of the court entering the related order and bars any settlement agreement or consent decree involving a federal agency—which results in a regulation (i.e., agency statement intended to have the force and effect of law, promulgated under APA notice-and-comment procedures) or guidance document (i.e., non-binding agency statement of general applicability setting policy or interpretations, such as memoranda or advisories)—from including payment of attorneys’ fees or litigation costs. The section also defines those terms and includes a severability clause.
