H.R. 8580 — Forestry Protection Act of 2026

This section reduces by 50 percent any duty or covered import restriction imposed under specified trade authorities on a finished forestry product if the importer demonstrates to the Commissioner of U.S. Customs and Border Protection that the product contains 100 percent raw wood material originating in the United States. It directs the Commissioner, in consultation with the United States Trade Representative, to issue implementing regulations within 90 days of enactment, including procedures for verification and fraud prevention, and defines covered import restriction, covered trade law, finished forestry product, and raw wood material.

This section requires the President to publish notice in the Federal Register at least 90 days before imposing or modifying a duty or other import restriction on a finished forestry product pursuant to a covered trade law. The notice must include the rate or amount of the duty or restriction, the specific legal authority, each affected product and its Harmonized Tariff Schedule code, the justification, and the proposed effective date, and must provide at least 60 days for public comment. Covered trade laws include section 338 of the Tariff Act of 1930, section 232 of the Trade Expansion Act of 1962, sections 122 and 301(b) of the Trade Act of 1974, and section 203 of the International Emergency Economic Powers Act.
