H.R. 8581 — SET Act

This section requires states to hold special elections to fill vacancies in the House of Representatives not later than 180 days after the vacancy occurs, unless a regularly scheduled general election for the seat is held within that 180-day period. It authorizes the Attorney General or an aggrieved person—including the Speaker or Minority Leader of the House—to bring a civil action against the relevant state chief executive for declaratory or injunctive relief to enforce the requirement.
