H.R. 8583 — Lowering Input Costs for American Farmers Act

This section exempts articles classified under heading 3103 or 3105 of the Harmonized Tariff Schedule of the United States (i.e., phosphate fertilizers) and imported from the Kingdom of Morocco from any duties imposed under section 122 or 301 of the Trade Act of 1974, effective beginning 7 days after the date of enactment of this Act.

This section revokes the countervailing duty orders on phosphate fertilizers from the Kingdom of Morocco (issued April 7, 2021), effective 4 business days after enactment, while leaving the orders in effect for imports from the Russian Federation. It directs the Secretary of Commerce to cease collection of duties and cash deposits on Moroccan imports, except for any duties assessed in administrative reviews completed before that effective date. This section also requires U.S. Customs and Border Protection to refund to the importer of record any non-excepted cash deposits paid on Moroccan imports, no later than 90 days after enactment.
