H.R. 8595 — National Security, Department of State, and Related Programs Appropriations Act, 2027

This section makes funds appropriated under title I of the Act available, except as otherwise provided, for (1) allowances and differentials as authorized by subchapter 59 of title 5, United States Code; (2) services as authorized by section 3109 of title 5, United States Code; and (3) hire of passenger transportation pursuant to section 1343(b) of title 31, United States Code.

This section requires any department or agency receiving funds appropriated or otherwise made available by this Act to submit to the Committees on Appropriations, not later than 30 days after the end of each fiscal quarter, a quarterly accounting of cumulative unobligated balances and obligated but unexpended balances by program, project, activity, and Treasury Account Fund Symbol for all such funds received in FY2027 or any prior fiscal year, disaggregated by fiscal year. The report must also specify, by account, the amount of funds obligated pursuant to bilateral agreements that have not been further sub-obligated.

This section limits expenditures of appropriations under title I of this Act for consulting services procured by contract pursuant to 5 U.S.C. § 3109 to those contracts where such expenditures are a matter of public record and available for public inspection, except as otherwise provided under existing law or Executive order issued pursuant to existing law.

This section specifies conditions on funds appropriated for “Embassy Security, Construction, and Maintenance,” including (1) an exception to cost-sharing limits under the Secure Embassy Construction and Counterterrorism Act of 1999, allowing new U.S. facilities overseas to include office space or accommodations for U.S. Marine Corps members; (2) prior consultation and notification requirements with the Committees on Appropriations for FY2027 property acquisitions and construction contracts overseas, early-stage consultations for out-year projects, and quarterly reports on contingency savings; (3) authority, following consultation, to address security vulnerabilities (e.g., physical upgrades, local guards) at interim and temporary diplomatic facilities abroad, with consultation and notification required for their opening, closure, or significant modification (waivable for security risks); (4) authority for security upgrades at soft targets (e.g., schools, recreational facilities, residences, places of worship) used by U.S. diplomatic personnel and dependents; and (5) prohibitions on using funds to relocate the U.S. embassy in Israel from Jerusalem or to establish any other U.S. diplomatic facility in Jerusalem.

This section requires departments and agencies funded under title I to absorb within their title I budgetary resources any costs from personnel actions taken in response to this Act's funding reductions. It authorizes transfers between appropriations accounts to implement this requirement (in addition to other transfer authorities in this Act) and treats such fund uses as reprogrammings under section 7015 of this Act.

This section prohibits the use of any funds appropriated by this Act for publicity or propaganda purposes within the United States unless authorized by Congress prior to the Act's enactment. It permits up to $25,000 for activities under sec. 316 of the International Security and Development Cooperation Act of 1980 (P.L. 96-533; 22 U.S.C. 2151a note).

This section prohibits the obligation or expenditure of funds appropriated under titles III through VI of this Act for direct assistance or reparations to the governments of Cuba, North Korea, or Iran, including direct loans, credits, insurance, and guarantees of the Export-Import Bank or its agents.

This section prohibits the obligation or expenditure of funds appropriated under titles III through VI for direct assistance to the government of any country whose duly elected head of government is deposed by military coup d'état or decree, or, after enactment, a coup d'état or decree in which the military plays a decisive role. Assistance may resume if the Secretary of State certifies to the appropriate congressional committees that a democratically elected government has taken office; the prohibition does not apply to assistance to promote democratic elections or public participation in democratic processes, or to support a democratic transition (subject to prior consultation with, and regular notification procedures of, the Committees on Appropriations). The Secretary of State may waive the prohibition on a program-by-program basis, following consultation with relevant federal agency heads, if vital to U.S. national security interests (subject to prior consultation with, and regular notification procedures of, the Committees on Appropriations).

This section authorizes transfers of up to 5% of appropriations under title I of the Act between such appropriations for the Department of State, with no single appropriation increased by more than 10% (except no transfers to increase Representation Expenses), and treats such transfers as reprogrammings subject to section 7015 procedures. It further permits (1) transfers among funds for Diplomatic Programs (including Worldwide Security Protection), Embassy Security, Construction, and Maintenance, and Emergencies in the Diplomatic and Consular Service to implement Benghazi Accountability Review Board recommendations, emergency evacuations, or security situations, subject to committee notification; (2) transfers of up to $50 million from Worldwide Security Protection to Emergencies in the Diplomatic and Consular Service for evacuations and rewards; and (3) transfers of up to $50 million from Diplomatic Programs to the Capital Investment Fund, with prior consultation for these specific authorities. This section prohibits transfers of funds under titles II through V to other U.S. government agencies except as provided in the Act or other appropriations acts (including under specified authorities of the Foreign Assistance Act of 1961 and BUILD Act section 1434(j)), requires notification for certain interagency agreements exceeding $2 million, and mandates prior consultation for humanitarian assistance transfers exceeding $7 million (or prompt after-action reporting if exigent). It also restricts transfers to the United States International Development Finance Corporation under BUILD Act section 1434(j) to funds under title III.

This section prohibits the use of appropriated funds for— (1) first-class travel by employees of agencies funded by this Act in contravention of specified federal travel regulations (41 C.F.R. § 301–10.122 through 301–10.124); (2) establishing or maintaining computer networks without filters blocking access to sexually explicit websites, subject to exceptions for law enforcement, prosecutions, administrative discipline, and official monitoring; (3) Department of State email accounts or servers outside the .gov domain or not fitted for automated records management, contravening the Presidential and Federal Records Act Amendments of 2014; (4) entertainment expenses under specified headings that include alcoholic beverages or substantially recreational activities (e.g., sporting events, theatrical productions, amusement parks); and requires agencies funded by the Act to ensure that representation and entertainment expenses further official business and U.S. foreign policy interests by primarily fostering relations outside the Executive Branch, focusing on protocol meals and events, excluding employee-only events, and avoiding recreational activities. This section also directs the Secretary of State to brief the Committees on Appropriations, not later than 30 days after enactment, on the Department of State's failure to comply with a FY2024 directive (House Report 118–146) to update interagency guidance on promoting tobacco control and the related reporting delay (House Report 119–217).

This section requires the Secretary of State to submit to the appropriate congressional committees, not later than 180 days after enactment, a report on implementation of the multi-year strategy to improve U.S. Government foreign assistance effectiveness required by section 7011(a) of the National Security, Department of State, and Related Programs Appropriations Act, 2026 (division F of Public Law 119–75). The report must include (1) a summary of preliminary implementation, including expert panel recommendations and beneficiary feedback/impact evaluations; (2) a process for incorporating such evidence into foreign assistance planning to prioritize cost-effective programs; (3) an assessment of required reforms; (4) standards for monitoring, evaluation, oversight, and vetting plans across the Department of State; (5) criteria for risk factors requiring enhanced precautions, plus a list of applicable countries and programs; (6) any strategy updates and reasons therefor; and (7) FY2026 staffing levels for planning, budgeting, executing, monitoring, evaluating, and auditing foreign assistance, plus planned FY2027 changes. This section also (1) makes funds appropriated for monitoring and evaluation under “National Security Investment Programs” and “International Humanitarian Assistance” available for regular beneficiary feedback collection to improve assistance quality and relevance, with Secretary of State oversight of implementing partners; (2) reserves not less than $15 million of funds under titles III and IV for impact evaluations (including ex-post) of foreign assistance programs' effectiveness and sustainability, in addition to other such funds; and (3) makes funds under title I, for independent agencies in title III, and under “Trade and Development Agency” and “United States International Development Finance Corporation” available, as appropriate, to provide additional foreign assistance information on ForeignAssistance.gov (i.e., the federal website tracking U.S. foreign aid), requiring all funded agencies to supply such data to the Department of State upon request.

This section prohibits the use of appropriations under titles III through VI to furnish assistance to any country in default for more than one calendar year on principal or interest owed to the United States on loans made under programs funded by the Act, unless the President determines, following consultation with the Appropriations Committees, that such assistance is in the U.S. national interest.

This section prohibits funds appropriated under titles III through VI from being made available for assistance to a foreign country under a new bilateral agreement unless the agreement exempts U.S. assistance from taxation or provides for reimbursement by the foreign government. It requires withholding from FY2028 (and prior fiscal years) assistance funds allocated to a foreign country's central government or the West Bank and Gaza program, as applicable, an amount equal to 200% of taxes assessed in FY2027 on U.S. assistance programs (directly or through grantees, contractors, and subcontractors) unless reimbursed by September 30, 2028, with a de minimis exception; withheld funds must be reprogrammed for assistance to countries that do not assess taxes on U.S. assistance or have effective reimbursement arrangements and can accommodate the funds responsibly. It authorizes the Secretary of State to waive these requirements if a foreign government or entity provides substantial reimbursement or if U.S. foreign policy interests outweigh the section's purpose, subject to a report to and 15-day consultation with the Appropriations Committees. The section defines "bilateral agreement" (i.e., a framework or individual U.S.-foreign government agreement on privileges, immunities, and tax treatment of U.S. assistance) and "taxes and taxation" (i.e., value added taxes and customs duties, excluding individual income taxes on local staff).

This section limits the availability of appropriations to the current fiscal year unless otherwise provided; authorizes reprogramming of funds specifically designated under titles III through VI for other programs within the same account if compliance with the designation is made impossible by this or any other Act, subject to regular Appropriations Committee notification procedures and the same terms and conditions; permits the Secretary of State to extend the original period of availability of designated funds administered by the Department of State for an additional fiscal year if termination of assistance to a country or a significant change in circumstances makes obligation unlikely, with prompt reporting to the Appropriations Committees and obligation limited to the original purpose; and provides that ceilings and specifically designated funding levels in this Act do not apply to funds appropriated by subsequent Acts unless specifically directed, and vice versa.

This section prohibits the obligation of funds appropriated under titles I, II, and VI of the Act and related prior-year and offsetting collections available for FY2027 for creating new programs; suspending or eliminating a program, project, or activity; closing, suspending, opening, or reopening a mission or post; creating, closing, reorganizing, downsizing, or renaming bureaus, centers, or offices; or contracting out or privatizing functions performed by federal employees unless previously justified to or notified 15 days in advance to the Appropriations Committees. It further prohibits reprogramming such funds in excess of $1 million or 10% (whichever is less) that augments or changes existing programs, relocates offices or employees, reduces funding or personnel by 10%, or results from general savings changing approved programs unless notified 15 days in advance. For funds under specified headings (e.g., Global Health Programs, Peace Corps, Foreign Military Financing Program), the section prohibits obligations for unjustified programs, projects, activities, materiel assistance, countries, or operations or in excess of justified amounts, and restricts presidential commitments for major defense equipment (e.g., aircraft, ships) previously unjustified or 20% above justified quantities, unless notified 15 days in advance (with exceptions for reprogrammings under 10% of prior justifications under titles III-VI). Finally, it requires (1) State Department justification, including costs, for supporting DoD-initiated programs; (2) notification for DoD transfers to State for foreign assistance; and (3) Appropriations Committee notification prior to providing excess DoD articles under specified authorities.

This section prohibits the use of funds appropriated by titles III through VI of the Act for any nongovernmental organization, including contractors, that fails to provide requested documents necessary for Department of State auditing. This section requires each federal agency funded by the Act to maintain a public website and post reports required by the Act to be submitted to Congress on that website not later than 45 days after Congress receives the report, subject to exceptions if the agency head determines that posting would compromise national security (including diplomacy) or reveal proprietary information, or if specifically exempted in the Act's accompanying report; requires posting only after providing the report to the Appropriations Committees; and requires posting in a central location on the agency's website. This section directs the Secretary of State to (1) regularly review and update policies for preserving federal records (including emails, instant messaging, and other online tools) in compliance with federal statutes, regulations, and executive orders; (2) use appropriated funds to improve records management under the Federal Records Act (44 U.S.C. Chapters 21, 29, 31, and 33) and related authorities; (3) direct departing employees, including senior officials, that all federal records they generate belong to the federal government; (4) substantially reduce, compared to the previous fiscal year, response times for identifying and retrieving federal records, including Freedom of Information Act requests; and (5) strengthen cybersecurity to mitigate vulnerabilities (including from non-.gov email), improve inactive account removal, update national security information controls, and implement applicable Office of Inspector General recommendations.

This section requires the head of the relevant federal agency to notify the Committees on Appropriations in writing within five days if the President determines not to comply with any provision of this Act on constitutional grounds, including the basis for the determination and any resulting changes to program or policy.

This section prohibits funds made available under part I of the Foreign Assistance Act of 1961 (i.e., economic development assistance programs) from being used to (1) pay for abortions as a method of family planning or to motivate or coerce any person to practice abortions; (2) pay for involuntary sterilizations as a method of family planning or to coerce or provide financial incentives for sterilizations; or (3) fund biomedical research related to methods of or performance of abortions or involuntary sterilizations as family planning. The section further prohibits obligating or expending such funds for any country or organization if the President certifies that its use would violate these provisions.

This section directs that funds appropriated under titles III through V be made available at not less than the amounts specified in tables in the accompanying report, which serve as the allocations for foreign countries and international organizations transmitted to Congress under section 653(a) of the Foreign Assistance Act of 1961 notwithstanding report timing. It authorizes the Secretary of State to deviate up to 10% below those amounts (up to 50% for exigent events or national security circumstances, subject to written notification and prior consultation with the Appropriations Committees); limits such deviations to post-653(a) report submission for designated amounts; excludes expired funds and minimum funding requirements; requires reports and consultations as specified in the accompanying report; and clarifies that International Humanitarian Assistance funds do not count toward country designations unless specified as the source.

This section prohibits the use of funds appropriated by this Act to pledge future-year funding for any multilateral or bilateral program funded in titles III through VI unless the pledge meets requirements specified in the report accompanying this Act under this section.

This section prohibits funds appropriated under titles III through VI from being made available to any foreign government that provides lethal military equipment to a country designated by the Secretary of State as supporting international terrorism under section 1754(c) of the Export Control Reform Act of 2018 (50 U.S.C. 4813(c)) for contracts entered into after October 1, 1997, with the prohibition terminating 12 months after the government ceases such provision. The President may determine that furnishing such restricted assistance is vital to the U.S. national interest and, if so, must submit a report to the Appropriations Committees detailing the assistance, its estimated dollar amount, and how it furthers the national interest. This section further prohibits such funds, including from prior appropriations acts for national security, Department of State, and related programs, from being made available to any foreign government that the President determines (1) grants sanctuary from prosecution to individuals or groups that have committed an act of international terrorism, (2) otherwise supports international terrorism, or (3) is controlled by an organization designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (8 U.S.C. 1189). The President may waive these prohibitions for national security or humanitarian reasons, subject to publication in the Federal Register and notification to the Appropriations Committees with justification at least 15 days prior to the waiver taking effect using regular procedures.

This section makes available not less than $108 million from funds appropriated under the headings “National Security Investment Programs,” “International Narcotics Control and Law Enforcement,” “Nonproliferation, Anti-terrorism, Demining and Related Programs,” “Security Sector Programs,” and “Foreign Military Financing Program” for the Prevention and Stabilization Fund (PSF) for purposes specified in the Global Fragility Act of 2019 (i.e., preventing conflict; stabilizing conflict-affected areas; supporting transitions to long-term peace and resilience; and addressing root causes of violence, fragility, and conflict). Funds made available from the Foreign Military Financing Program remain available until September 30, 2028.

This section defines “program, project, and activity” for titles II through VI of the Act at the appropriations Act account level, including all appropriations and authorizations Acts funding directives, ceilings, and limitations. For the National Security Investment Programs, International Narcotics Control and Law Enforcement, and Foreign Military Financing Program accounts, the definition also includes country-, regional-, and central program-level funding within each account, either (1) as justified to Congress or (2) as allocated by the Executive Branch pursuant to the report required by section 653(a) of the Foreign Assistance Act of 1961 or as modified under section 7019 of this Act.

This section restricts funds appropriated by this Act and prior Acts for national security, Department of State, and related programs countering foreign propaganda and disinformation to use only for countering such efforts by foreign state and non-state actors abroad. The section further prohibits such funds from being used (1) in contravention of Executive Order 14149, relating to Restoring Freedom of Speech and Ending Federal Censorship; (2) to characterize U.S. independent news media companies as creators of disinformation, misinformation, or malinformation; (3) to advocate to, or act to, censor, filter, or remove content from a U.S. entity on social media platforms; or (4) to take any action designed to influence consumer or advertising behavior toward U.S. media companies or social network platforms.

This section prohibits the obligation or expenditure of funds appropriated by titles III through VI of the Act for direct assistance, or otherwise made available to the Export-Import Bank or the U.S. International Development Finance Corporation, to finance loans, assistance, or financial commitments for establishing or expanding foreign production of any commodity for export if the commodity is likely in surplus on world markets when the capacity becomes operative and the assistance causes substantial injury to U.S. producers of the same, similar, or competing commodity. Exceptions apply to (1) Export-Import Bank activities if its Board of Directors determines U.S. industry and employment benefits outweigh injury and the Board Chair notifies the Committees on Appropriations; (2) activities in countries eligible for International Development Association assistance, ineligible for International Bank for Reconstruction and Development assistance, and not consistently exporting the commodity; and (3) activities in countries the President determines are recovering from widespread conflict, humanitarian crisis, or complex emergency. The section further prohibits funds appropriated for chapter 1 of part I of the Foreign Assistance Act of 1961 from supporting specified activities (e.g., testing, breeding feasibility studies, or training) connected to foreign growth or production of agricultural commodities for export competing with U.S. products, with exceptions for (1) food security activities in developing countries with no significant U.S. export impact; (2) research primarily benefiting U.S. producers; and (3) and (4) the country categories in subsection (a)(2) and (3) above. Finally, this section directs the Secretary of the Treasury to instruct the U.S. executive director of each international financial institution to oppose any assistance using funds appropriated or made available by the Act for production or extraction of any commodity or mineral for export if in surplus on world markets and causing substantial injury to U.S. producers of the same, similar, or competing commodity.

This section requires separate accounts for local currencies generated under assistance agreements pursuant to chapters 1 and 10 of part I or chapter 4 of part II of the Foreign Assistance Act of 1961 (i.e., development assistance programs, assistance for the independent states of the former Soviet Union, and international disaster assistance). Specifically, it directs the Secretary of State to (1) require deposit of such currencies in a separate account established by the foreign government; (2) enter into agreements specifying the amount generated, terms of use (limited to project/sector assistance, debt/deficit financing under the applicable chapters, or U.S. administrative costs), and monitoring responsibilities; (3) ensure programming accountability for disbursements; and (4) upon program termination, dispose of unencumbered balances as agreed by the U.S. and foreign governments. (Thus, the provision promotes fiscal transparency and restricts commingling of aid-generated currencies.) This section further requires countries receiving cash transfer or nonproject sector assistance under the same chapters to maintain funds in a separate account without commingling, with at least 15 days' prior notification to the Committees on Appropriations detailing proposed uses and U.S. interests served (including economic policy reforms, as appropriate); exemptions for nonproject sector assistance are available through the same notification procedures.

This section waives restrictions on assistance to certain countries (1) for programs of nongovernmental organizations using funds appropriated for chapters 1, 10, 11, and 12 of part I and chapter 4 of part II of the Foreign Assistance Act of 1961, the FREEDOM Support Act, and the Support for East European Democracy Act, subject to prior notification to the Committees on Appropriations; and (2) during FY2027 for assistance under the Food for Peace Act, subject to notification procedures for title I funds. This section does not apply to prohibitions on assistance to governments that support international terrorism or violate internationally recognized human rights.

This section directs the Secretary of State, consistent with the Championing American Business Through Diplomacy Act of 2019, to (1) prioritize, in consultation with the Secretary of Commerce, funds appropriated under Diplomatic Programs for Chief of Mission diplomatic engagement to foster commercial relations and safeguard U.S. economic and business interests—with such prioritization reflected in each Mission Resource Request and Bureau Resource Request; (2) annually assess training needs across economic and commercial diplomacy issue areas under that Act and ensure current course offerings meet those needs; and (3) direct each Chief of Mission to advance U.S. commercial relations and business interests in the applicable Integrated Country Strategy and Mission Resource Request for countries receiving bilateral assistance under this Act.

This section prohibits payments of funds appropriated under title V of this Act to any international financial institution (IFI) if the U.S. executive director's total compensation exceeds the rate for level IV of the Executive Schedule (5 U.S.C. 5315) or the alternate U.S. executive director's compensation exceeds the rate for level V (5 U.S.C. 5316); directs the Secretary of the Treasury to instruct U.S. executive directors at IFIs to promote human rights due diligence, oppose loans or assistance to China at multilateral development banks, include anti-fraud and anti-corruption measures in financing agreements, and encourage collection and publication of beneficial ownership information for non-public corporations or limited liability companies receiving IFI funds; restricts U.S. contributions to Treasury-overseen financial intermediary funds from supporting China or U.S.-sanctioned countries or regions; conditions support for new IFI capital increases on a presidential budget request and Treasury certification that the increase advances institutional objectives with reforms and does not increase China's voting power relative to the United States; requires a Treasury report to the Appropriations Committees within 120 days of enactment detailing prior-year funding by such financial intermediary funds to China or sanctioned countries or regions; and directs the U.S. executive director at the Inter-American Development Bank to advance procurement reforms benefiting U.S. businesses and eliminate green and climate finance targets in favor of affordable energy for economic growth and poverty reduction, with certification to the Appropriations Committees required prior to obligating funds under the "Contribution to the Inter-American Development Bank" heading.

This section makes funds appropriated under the “National Security Investment Programs” heading available for the Economic Resilience Initiative to enhance the economic security and stability of the United States and partner countries, including through efforts to counter economic coercion, subject to consultation with and notification to the Committees on Appropriations. Such funds support (1) strategic infrastructure investments administered by the Secretary of State in consultation with other relevant federal agencies; (2) activities to enhance critical mineral supply chain security; and (3) the Cyberspace, Digital Connectivity, and Related Technologies Fund under the Foreign Assistance Act of 1961, including for the Digital Connectivity and Cybersecurity Partnership program. The section further authorizes transfers of such funds to, and their merger with, funds appropriated to the Export-Import Bank (“Program Account”), U.S. International Development Finance Corporation (“Corporate Capital Account”), and Trade and Development Agency, in addition to other transfer authorities and subject to notification procedures.

This section limits direct government-to-government foreign assistance to funds that meet specified anti-corruption and fiscal requirements from prior-year appropriations acts (i.e., 2019 and 2014), including steps by recipient governments to reduce corruption; requires prior consultation with and notification to the Committees on Appropriations for assistance exceeding $7 million or involving cash transfers, budget support, or payments to individuals (with explanations of compliance); directs suspension of assistance upon credible evidence of material misuse unless continuation is deemed in the U.S. national interest or misuse is addressed; requires submission to the Committees on Appropriations of planned assistance amounts by country with the FY2028 congressional budget justification; and prohibits use of funds by recipient governments for debt service payments to international financial institutions or China. The section also requires the Secretary of State to update and strengthen minimum fiscal transparency requirements for recipient governments and, within 180 days of enactment, to determine and publicly report annually on each government's "significant progress" or "no significant progress" toward meeting them via a Fiscal Transparency Report on the Department of State website. In addition, the section renders ineligible for U.S. entry foreign government officials and immediate family members credibly involved in significant corruption (including natural resource extraction) or gross human rights violations (including wrongful detention of U.S. diplomatic mission staff or U.S. citizens/nationals), with concurrent referrals to Treasury's Office of Foreign Assets Control for potential sanctions, public or private designations, limited exceptions for U.S. law enforcement or UN obligations, waiver authority for national interest or changed circumstances, and reports to specified congressional committees every 90 days through September 30, 2028 (with unclassified portions posted online), listing ineligible or designated individuals and any waivers with justifications.

This section makes available $2,175,000,000 for democracy programs from funds appropriated under the headings “National Security Investment Programs,” “Democracy Fund,” and “International Narcotics Control and Law Enforcement,” as well as funds under “National Endowment for Democracy”; such funds are restricted to programs in adversarial or anti-American countries, countries whose malign activities pose a national security threat to the United States, or countries seeking to strengthen democratic institutions and processes (i.e., State Department and nongovernmental initiatives to promote democracy abroad). The section further (1) authorizes these funds notwithstanding any other provision of law (and, for the National Endowment for Democracy, any regulation), with beneficiary selection for National Endowment for Democracy funds pursuant to the National Endowment for Democracy Act; and (2) prohibits prior approval by foreign governments of implementing organizations, assistance nature, or participants, while barring requirements to disclose implementing partners' names in new bilateral agreements with undemocratic governments that have harassed such programs (and directing amendments to existing agreements).

This section directs funds appropriated by the Act under specified headings for international religious freedom purposes as follows: (1) makes available funds under Diplomatic Programs for the Office of International Religious Freedom in the Department of State; (2) requires not less than $50 million from funds under National Security Investment Programs and Democracy Fund for international religious freedom programs, administered by the Ambassador-at-Large for International Religious Freedom (prioritized for countries designated as countries of particular concern—i.e., those with particularly severe violations of religious freedom—under the International Religious Freedom Act of 1998); (3) makes available funds under International Humanitarian Assistance for aid to vulnerable and persecuted ethnic and religious minorities, including victims of genocide designated by the Secretary of State and groups suffering crimes against humanity or ethnic cleansing; and (4) authorizes funds under National Security Investment Programs for assistance to ethnic and religious minorities in Iraq and Syria notwithstanding any other provision of law.

This section makes available not less than $15 million from funds appropriated under the headings "National Security Investment Programs" and "International Narcotics Control and Law Enforcement" for forensic assistance related to combating human trafficking. This section permits funds appropriated under "National Security Investment Programs" for contributions to establish and maintain genocide victims memorial sites, subject to notification procedures of the Committees on Appropriations; prohibits use of funds to modify the State Department's Exchange Visitor Program except through formal rulemaking under the Administrative Procedure Act, with consultation and notification to the Committees on Appropriations at least 30 days prior to Federal Register publication regarding public diplomacy goals and economic impacts; requires consultation with the Committees on Appropriations prior to initiating or significantly changing partner vetting programs and authorizes restricting, terminating, or canceling awards based on vetting information; directs the Secretary of State to withhold title III assistance funds from central governments of countries not taking steps to comply with the Hague Convention on International Child Abductions, with a report to the Committees on Appropriations within 15 days; and authorizes transfer of up to $50 million in unobligated expired fiscal year 2027 "Diplomatic Programs" funds to "Protection of Foreign Missions and Officials" no later than the end of the fifth fiscal year after the funds' last availability. This section continues in effect during fiscal year 2027 (1) section 7056 of division K, Public Law 116-260, on impact on jobs; (2) section 7081(h) of division J, Public Law 115-31, on transfer of balances; and (3) section 7071 of division K, Public Law 117-103, on protective services, applying to funds appropriated by this Act. This section extends loan guarantees to Israel under chapter 5 of title I of Public Law 108-11 through September 30, 2032 (from September 30, 2031). This section expands the HIV/AIDS Working Capital Fund to make available pharmaceuticals and products for child survival, malaria, and tuberculosis to the same extent as for HIV/AIDS, subject to exercise of specified authorities by the Secretary of State and notification procedures of the Committees on Appropriations, and requires an accounting of the fund in the congressional budget justification. This section defines "appropriate congressional committees" for this Act as the Committees on Appropriations and Foreign Relations of the Senate and the Committees on Appropriations and Foreign Affairs of the House of Representatives and clarifies that, in relevant appropriations acts, the term "contribution, grant, or other payment" to the United Nations or affiliates includes voluntary and assessed contributions and payments to the UN Regular Budget.

This section authorizes assistance and authorities for security assistance programs and imposes related limitations. **Assistance.** The section (1) permits funds under titles III and IV of the Act for specified chapters of the Foreign Assistance Act of 1961 (FAA) to enhance civilian police effectiveness and accountability through training in human rights, rule of law, anti-corruption, and related areas, notwithstanding FAA §660 (which generally prohibits assistance for foreign police); and (2) makes funds under Security Sector Programs and Foreign Military Financing Program (FMF) available for combat casualty care training and equipment above the prior fiscal year amount, requiring the Secretary of State to offer such assistance with any lethal assistance package to countries in conflict unless they have adequate systems, via open competition. **Authorities.** The section (1) expands FAA §660(b)(6) authority for reconstituting civilian police in nations emerging from instability to include sub-national entities; (2) continues FY2015 authority for disarmament, demobilization, and reintegration programs under National Security Investment Programs through FY2027; (3) authorizes commercial leasing financing under Arms Export Control Act (AECA) §23(a) for defense articles (excluding most major defense equipment) to Israel, Egypt, NATO, and major non-NATO allies; (4) permits up to $900 million obligation for the AECA Special Defense Acquisition Fund through September 30, 2029; (5) extends war reserve stockpile authority through 2029 (from 2028); (6) clarifies that non-repayable FMF financing may include U.S. military salaries for the State Partnership Program in FY2027; (7) continues FMF direct loan and loan guarantee authorities through FY2028; and (8) continues prior FY2024 authority through FY2027. **Limitations.** The section states that funds should not support military training or operations involving child soldiers and authorizes grant disposal of U.S. demining equipment used for humanitarian landmine and unexploded ordnance clearance.

This section makes available not less than $175 million from funds appropriated under the headings “National Security Investment Programs” and “International Narcotics Control and Law Enforcement” for programs to counter the flow of fentanyl, fentanyl precursors, and other synthetic drugs into the United States, in addition to funds otherwise available for such purposes. Such funds shall support (1) efforts to stop the flow of those drugs and precursor materials to the United States from and through the People’s Republic of China, Mexico, and other countries; (2) law enforcement cooperation and capacity building to disrupt and dismantle transnational criminal organizations involved in their production and trafficking; (3) implementation of the Fighting Emerging Narcotics Through Additional Nations to Yield Lasting Results Act; and (4) multilateral engagement, including through the Global Coalition to Address Synthetic Drug Threats, to address related public health and security threats.

This section prohibits funds appropriated under titles III through VI of this Act from being used to support a Palestinian state unless the Secretary of State certifies to the appropriate congressional committees that (1) the governing entity demonstrates a firm commitment to peaceful co-existence with Israel and is countering terrorism and terrorist financing in the West Bank and Gaza, including dismantling terrorist infrastructure and cooperating with Israeli and other security organizations; and (2) the Palestinian Authority (or governing entity) pursues regional efforts for a just, lasting, and comprehensive Middle East peace enabling Israel and an independent Palestinian state to exist within full and normal relations, including termination of belligerency, respect for sovereignty and territorial integrity through demilitarized zones, secure boundaries free from force, freedom of navigation, and a refugee settlement framework. This section expresses the sense of Congress that the governing entity enact a constitution assuring rule of law, an independent judiciary, human rights, and transparent governance. The President may waive these restrictions if vital to U.S. national security interests. The prohibition does not apply to assistance reforming the Palestinian Authority or governing entity to meet these conditions, consistent with section 7040 of this Act.

This section prohibits the use of funds appropriated or otherwise made available by this Act to provide equipment, technical support, consulting services, or any other form of assistance to the Palestinian Broadcasting Corporation (i.e., the Palestinian Authority's state broadcaster).

This section establishes oversight, vetting, prohibition, audit, and notification requirements for assistance to the West Bank and Gaza under the National Security Investment Programs heading as follows: (1) requires the Secretary of State, for FY2027, to certify 30 days prior to initial obligation of funds that procedures ensure Comptroller General access to financial information for program review; (2) mandates vetting prior to obligation to prevent assistance to individuals, entities, or educational institutions involved in or advocating terrorist activity, with termination of assistance if determined; (3) prohibits funds for recognizing acts of terrorism or naming educational institutions after individuals who committed terrorism and withholds security assistance until a report to the Appropriations Committees on Palestinian compliance with benchmarks and steps to end torture by security forces; (4) directs the Secretary to ensure annual audits of contractors and grantees, with up to $1.4 million available to Offices of Inspector General for such activities; (5) requires a Comptroller General audit and investigation of FY2027 funds for compliance and program examination; and (6) subjects funds to regular notification procedures of the Appropriations Committees.

This section prohibits funds appropriated by this Act to carry out chapter 4 of part II of the Foreign Assistance Act of 1961 (i.e., West Bank and Gaza Program) from being obligated or expended for the Palestinian Authority (PA), subject to a presidential waiver—certified in writing as important to U.S. national security interests and provided to specified congressional leaders and the Appropriations Committees—that is effective for no more than six months at a time and not beyond 12 months after enactment. Waivers require a presidential report to the Appropriations Committees on justification, fund uses, accounting procedures, and PA actions to arrest terrorists, confiscate weapons, and dismantle terrorist infrastructure; additionally, prior to fund obligation, the Secretary of State must certify and report to the Committees that the PA maintains a single treasury account with no parallel mechanisms, a single civil service roster and payroll, and is countering anti-Israel incitement while promoting peace and security cooperation with Israel. (Thus, these conditions aim to ensure U.S. aid does not support terrorism or parallel governance structures.) The section further prohibits funds appropriated in titles III through VI from being used for PA salaries in Gaza or assistance to Hamas, Hamas-controlled entities, Hamas power-sharing governments, or the Palestine Liberation Organization; assistance to power-sharing governments is permitted only upon presidential certification of compliance with specified anti-terrorism principles in section 620K(b)(1)(A) and (B) of the Foreign Assistance Act of 1961, with required quarterly reports to the Appropriations Committees on continued compliance, aid amounts, purposes, and delivery.

This section (1) makes available not less than $1.425 billion in assistance for Egypt, including $125 million from National Security Investment Programs and $1.3 billion from the Foreign Military Financing Program (FMF), notwithstanding most other restrictions pending a certification that the Egyptian government is sustaining the U.S. strategic relationship and meeting its obligations under the 1979 Egypt-Israel Peace Treaty, and directs the Secretary of State to prioritize diplomatic engagements on long-term security assistance planning; (2) directs funds under Diplomatic Programs, National Security Investment Programs, and Nonproliferation, Anti-terrorism, Demining, and Related Programs to counter Iran's nuclear program, enforce sanctions, and support Iranian democracy programs; requires semi-annual reports on Iran's nuclear activities and a report within 180 days on U.S. sanctions against Iran; and prohibits such funds from implementing or renewing the Joint Comprehensive Plan of Action in contravention of the Iran Nuclear Agreement Review Act of 2015, assisting Iran-sanctioned entities, or revoking the Islamic Revolutionary Guard Corps' foreign terrorist organization designation; (3) makes available not less than $3.3 billion from FMF for grants only to Israel, to be disbursed within 30 days of enactment and available, as agreed by the United States and Israel, for advanced weapons systems including not less than $250.3 million for procurement in Israel of defense articles and services; (4) makes available not less than $1.65 billion in assistance for Jordan from titles III and IV, including $845.1 million for budget support and $425 million from FMF, plus an additional $400 million from National Security Investment Programs for budget support and $50 million from FMF; and (5) prohibits funds for Lebanon's Internal Security Forces or Armed Forces if controlled by a foreign terrorist organization and authorizes funds under International Narcotics Control and Law Enforcement and FMF for their programs and equipment to address security.

This section directs funds appropriated under titles III and IV of the Act for the African Great Lakes region to support the June 27, 2025, Peace Agreement between the Democratic Republic of the Congo and the Republic of Rwanda and implementation of the Regional Economic Integration Framework, prioritizing sectors critical to U.S. national security and economic interests, including mining and natural resources. For Nigeria, the section (1) withholds 50% of such funds for the central government until the Secretary of State certifies steps to prevent and respond to violence, support victims including internally displaced persons, facilitate community return and reconstruction, and allocate sufficient resources for those actions; and (2) requires such funds to be provided on a cost-matching basis to the maximum extent practicable for specified priorities, including atrocities prevention, religious freedom, investigations of violence by specified groups, security force accountability, humanitarian assistance, restoration of basic services, and demobilization, disarmament, and reintegration efforts. This section prohibits such funds for the government of (1) South Africa unless the Secretary of State certifies compliance with conditions in the Act's accompanying report on ceasing cooperation with U.S. adversaries and adhering to the rule of law; (2) South Sudan under title IV, except to support implementation of a viable peace agreement; and (3) Sudan under title IV, except to support implementation of a viable peace agreement, with any new programs, projects, or activities in Sudan subject to prior consultation with the appropriate congressional committees.

This section makes funds appropriated under the heading “National Security Investment Programs” available for assistance for Burma consistent with specified authorities in the Burma Act of 2022 and prior-year appropriations act, applying limitations from the prior act except minimum funding requirements and one specified paragraph. This section requires (1) not less than $1,800,000,000 from titles III and IV for implementation of the Indo-Pacific Strategy; (2) not less than $400,000,000 from specified accounts—including “National Security Investment Programs,” “International Narcotics Control and Law Enforcement,” “Nonproliferation, Anti-terrorism, Demining and Related Programs,” and “Foreign Military Financing Program”—for a Countering PRC Influence Fund subject to prior consultation with the Committees on Appropriations, with up to 10% held in reserve, Foreign Military Financing Program funds available until September 30, 2028, and specified transfer authority; (3) prohibits funds from supporting China’s Belt and Road Initiative, dual-use infrastructure projects, or specified Chinese technologies unless the Secretary of State determines no adverse impact on U.S. national security; and (4) prohibits funds for maps inaccurately depicting Taiwan’s territory. This section makes funds under “Administration of Foreign Affairs” available to increase Department of State personnel and facilities in Australia to advance U.S. national security objectives, including AUKUS implementation, as reflected in the section 7062 operating plan following congressional consultation. This section (1) prohibits assistance for the central government of any country determined to engage in significant transactions contributing to North Korea’s malicious cyber capabilities, with a required report under the North Korea Sanctions and Policy Enhancement Act of 2016 and a national security waiver; (2) requires funds under “International Communications Activities” to maintain broadcasting hours into North Korea at prior fiscal year levels; (3) makes funds under “National Security Investment Programs” and “Democracy Fund” available for human rights promotion in North Korea, applying section 7032(b)(1) authority; and (4) prohibits funds under “National Security Investment Programs” for the Government of North Korea. This section [incomplete in provided text] makes funds appropriated under the heading “Administration o[f Foreign Affairs]” available for operations in Pacific Islands countries.

This section prohibits the use of funds appropriated or otherwise made available by this Act or prior Acts for national security, Department of State, and related programs for assistance to the Taliban.

This section establishes priorities and conditions for funds appropriated by the act under titles III and IV for Latin America and the Caribbean. It requires such funds to prioritize countries and programs (1) countering fentanyl and other narcotics trafficking; (2) respecting norms of democracy, constitutional order, and human rights; (3) cooperating against regional and global authoritarian threats; and (4) demonstrating progress in offsetting large-scale migration and human trafficking from or through the Western Hemisphere. This section makes funds under titles III and IV available for Central America, including Panama and Costa Rica, allocated to address each country's unique circumstances in support of U.S. security interests. **Colombia.** This section requires a pre-obligation report from the Secretary of State to congressional committees on U.S.-Colombia bilateral relations, including alignment with U.S. interests such as mitigating irregular migration, supporting rule of law and democracy, and countering narcotics, terrorism, human trafficking, and antisemitism. It withholds 30% of funds under International Narcotics Control and Law Enforcement for Colombia until the Secretary certifies that, in the prior 12 months, Colombia has reduced coca cultivation, production, and drug trafficking; cooperated on joint counternarcotics operations; and maintained extradition cooperation (with exceptions for aviation instruction/maintenance and maritime/riverine security programs). It authorizes aircraft funded by the act or prior acts for drug eradication, interdiction, and related security; prohibits funds for reparation payments, alternative development on properties with illegal controlled substances, compensation to demobilized combatants under the 2016 peace accord, or agrarian cash subsidies; and provides up to $1 million under National Security Investment Programs for State Department Inspector General audits of compliance with the alternative development prohibition (in addition to other available funds). **Cuba.** This section requires not less than $35 million under National Security Investment Programs for democracy and civil society programs, including support for political prisoners, prohibiting funds for business promotion, economic reform, entrepreneurship, or other non-democracy-building assistance not expressly authorized by the Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996 or Cuban Democracy Act of 1992. It prohibits title I public diplomacy funds for such non-democracy-building activities or exchanges in Cuba or with Cuban nationals abroad; bars use of act or prior act funds to revoke Cuba's State Sponsor of Terrorism designation or eliminate/diminish the Cuba Restricted List (or facilitate transactions with listed entities, Cuban military/intelligence, high-level Communist Party members, their licensees, or immediate family); and prohibits act or prior act funds for any individual or entity engaging in financial transactions, fund transfers, or material support to Cuba's Ministries of Revolutionary Armed Forces or Interior or their subdivisions.

This section exempts specified activities from restrictions under sec. 907 of the FREEDOM Support Act (i.e., assistance restrictions applicable to certain former Soviet states, primarily Azerbaijan, for blocking regional economic cooperation), including (1) democracy support and assistance under title V of that Act, sec. 1424 of the Defense Against Weapons of Mass Destruction Act of 1996, or non-proliferation assistance; (2) Trade and Development Agency assistance; (3) U.S. and Foreign Commercial Service activities; (4) U.S. International Development Finance Corporation assistance under the BUILD Act of 2018; (5) Export-Import Bank financing; and (6) humanitarian assistance. The section restricts FY2027 funds from assistance to governments of independent states of the former Soviet Union that direct actions violating the territorial integrity or national sovereignty of other such states (per the Helsinki Final Act), unless the President determines it is in the U.S. national security interest following consultation with the Appropriations Committees. The section continues in effect during FY2027, and applies to funds appropriated by this Act, the limitations and provisions of sec. 7046(c) (Turkey) and sec. 7046(d) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2024.

This section prohibits funds appropriated by the act from being made available for assistance to the central government of the Russian Federation. The section further prohibits such funds for assistance to the central government of any country that supports Russia's annexation of Crimea or other Ukrainian territory, as determined by the Secretary of State; limits funds from recognizing Russian sovereignty over such territory, facilitating U.S. investments involving Russian entities, or providing assistance involving such entities; directs the Secretary of the Treasury to oppose assistance by international financial institutions (IFIs) violating Ukraine's sovereignty or territorial integrity; and terminates these measures upon Ukraine's reestablishment of sovereignty (with a national interest waiver available). Similarly, the section prohibits such funds for assistance to the central government of any country that recognizes the independence of or diplomatic relations with Russian-occupied Georgian territories of Abkhazia and Tskhinvali Region/South Ossetia, as determined and listed by the Secretary of State (with a national interest waiver available); limits funds from supporting the Russian occupation; and directs the Secretary of the Treasury to oppose IFI assistance violating Georgia's sovereignty or territorial integrity. Finally, this section makes available not less than $300 million from specified prior and current appropriations under National Security Investment Programs, International Narcotics Control and Law Enforcement, International Military Education and Training, and Foreign Military Financing Program headings for the Countering Russian Influence Fund (CRIF), as authorized by the Countering Russian Influence in Europe and Eurasia Act of 2017 (22 U.S.C. 9543)—notwithstanding CRIF's country limitation—to counter Russian influence and enhance law enforcement and security force capacity, with Foreign Military Financing Program funds available through September 30, 2028.

This section requires the Secretary of State, in considering bilateral assistance, to review foreign governments' United Nations voting practices relative to U.S. strategic interests and support for Taiwan's participation as an observer in UN activities and to consult with the U.S. Permanent Representative to the UN prior to submitting certain reports. It withholds 15% of funds appropriated by this Act for UN contributions (including the Department of Peacekeeping Operations), international organizations, or UN agencies until the Secretary certifies and reports to congressional committees that the entity is posting public audits with U.S. access; implementing U.S.-level whistleblower protections (including against retaliation for disclosures, burdens of proof, statutes of limitation, independent adjudication, and remedies); restricting first- and business-class travel; combating anti-Israel bias; notifying donors of fund diversions; and vetting staff for terrorist affiliations. It prohibits funds made available by this Act from paying U.S. delegation expenses to any UN specialized agency, body, or commission chaired by a country determined to support international terrorism under specified laws and from contributing to any UN organization, agency, commission, or program similarly chaired. This section further prohibits funds appropriated by this Act and prior related acts from being made available to the UN Human Rights Council (including its International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel) or the UN Office of the High Commissioner for Human Rights; to the United Nations Relief and Works Agency (UNRWA) or to solicit funds for UNRWA from other sources; or to pay any UN member assessments, arrearages, or dues or, from specified foreign assistance funds, the costs of another country's delegation participation at multilateral conferences. Finally, it requires a report to the Appropriations Committees within 45 days of enactment detailing FY2027 funds withheld from UN or international programs due to any provision of law, with updates upon additional withholdings.

This section prohibits obligation or expenditure of funds appropriated by this Act or prior Acts for national security, Department of State, and related programs for (1) the Secretariat of the United Nations or any affiliated office, agency, fund, program, or entity until the Secretary of State certifies to congressional committees that the UN Secretary-General has provided written assurance that UN privileges, exemptions, and immunities will not be asserted for staff, consultants, or contractors of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) or other UN entities in cases of gross human rights violations, terrorism acts, material support to terrorist organizations or designated entities, or serious U.S. criminal conduct (including corruption) outside official duties; and (2) any covered entity if an Inspector General funded under title II notifies the Secretary of State that the entity failed for more than 90 days to provide requested oversight information on Gaza programs or activities, the October 7, 2023, attacks in Israel, or material support to terrorists or sanctioned entities. Covered entities include multilateral organizations, NGOs, contractors, grantees, or others that directly or indirectly receive or have received such funds for Gaza activities within the prior five years.

This section makes available not less than $78,375,000 of funds appropriated by this Act for programs to promote internet freedom globally (i.e., State Department and USAID efforts to counter censorship and support open internet access), consistent with section 9707 of the Department of State Authorization Act of 2022.

This section prohibits the use of funds provided by this Act to support or justify the use of torture and other cruel, inhuman, or degrading treatment or punishment by any official or contract employee of the United States Government.

This section provides authorities for the transfer, coordination, operation, and maintenance of aircraft procured by the Department of State (State) with funds appropriated under specified headings for diplomatic programs and international narcotics control and law enforcement, including the former Andean Counterdrug Initiative and Programs. Specifically, the section (1) authorizes such aircraft to be transferred for use in any other program or region after the Secretary of State determines they are excess to needs in their original location and notifies the Appropriations Committees, subject to prior consultation; (2) requires coordination of aircraft use under the relevant Chief of Mission, including transport of federal and non-federal personnel on a reimbursable or non-reimbursable basis (with other-agency official travel supported on a reimbursable basis or space-available without reimbursement), and permits crediting related funds to State's Working Capital Fund for aircraft expenses—applicable only to aircraft primarily for personnel transport; (3) directs that recipient countries bear operations and maintenance costs, including fuel, to the maximum extent practicable; and (4) exempts unmanned aircraft weighing less than 55 pounds from transfer restrictions under Section 484(a)(2) of the Foreign Assistance Act of 1961 (22 U.S.C. 2291c(a)(2)) during FY2027.

This section applies to this Act the terms and conditions of section 7055 of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2010 (division F of P.L. 111-117)—which conditions assistance to Mexico on certifications by the Secretary of State that the Mexican government is upholding human rights, prosecuting cases involving security forces, cooperating on counternarcotics and border security, and implementing judicial reform—by extending the date in subsection (f)(2)(B) to September 30, 2026 (from September 30, 2009).

This section (1) applies to this Act the terms and conditions of sections 7086(b)(1) and (2)—which impose restrictions on certain loans to Pakistan—and 7090(a)—which addresses multilateral debt restructuring—of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2010 (division F of Public Law 111-117); and (2) directs the Secretary of the Treasury to instruct the U.S. Executive Director of the IMF to seek to ensure that any loan is repaid to the IMF before other private or multilateral creditors.

This section prohibits the use of funds appropriated by the Act, except under the headings "National Security Investment Programs," "International Humanitarian Assistance," "International Narcotics Control and Law Enforcement," "United States Emergency Refugee and Migration Assistance Fund," and "Nonproliferation, Anti-terrorism, Demining and Related Assistance," to provide assistance to the central government of a country that notifies the Department of State of its refusal to extradite to the United States any individual indicted for a criminal offense punishable by life imprisonment without parole or for killing a law enforcement officer, as specified in a U.S. extradition request. The prohibition applies only to countries with which the United States maintains diplomatic relations and an extradition treaty and that are in violation of the treaty. The Secretary of State may waive the prohibition on a case-by-case basis upon certifying to the Committees on Appropriations that it is important to the U.S. national interest.

This section prohibits the obligation of funds appropriated under titles III through VI for Enterprise Funds unless the appropriate congressional committees are notified at least 15 days in advance; requires the President, prior to the distribution of any assets resulting from the liquidation, dissolution, or winding up of an Enterprise Fund, to submit to the appropriate congressional committees a plan for the distribution of those assets; and requires the President, prior to a transition to or operation of any private equity fund or other parallel investment fund under an existing Enterprise Fund, to submit a transition or operating plan to the appropriate congressional committees. (Enterprise Funds are U.S. government programs, typically administered by USAID or the State Department, that provide equity investments, loans, and technical assistance to promote private sector development in emerging markets.)

This section (1) prohibits any funds appropriated or otherwise made available by this Act from being provided to the United Nations Population Fund, and (2) prohibits funds appropriated under title III and the headings “International Narcotics Control and Law Enforcement,” “Nonproliferation, Anti-terrorism, Demining and Related Programs,” “Security Sector Programs,” “Peacekeeping Operations,” and “International Organizations and Programs” in this Act and prior Acts making appropriations for national security, the Department of State, and related programs from being made available in contravention of the rule entitled “Protecting Life in Foreign Assistance” published in the Federal Register on January 27, 2026 (91 Fed. Reg. 3319 et seq.).

This section waives other legal restrictions on funds appropriated by titles III and IV for bilateral assistance related to child survival activities or disease programs, including HIV/AIDS research, prevention, treatment, and control, except under the Global Health Programs heading and the U.S. Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003 (22 U.S.C. 7601 et seq.); limits family planning/reproductive health assistance to $461 million; and authorizes funds under Global Health Programs for global health security activities to prevent, detect, and respond to infectious disease outbreaks (with required consultation with the Committees on Appropriations within 60 days of enactment). The section further permits the Secretary of State to transfer and merge up to an aggregate $200 million from Global Health Programs, National Security Investment Programs, International Humanitarian Assistance, Democracy Fund, and Millennium Challenge Corporation accounts to combat a sustained, severe international infectious disease outbreak or Public Health Emergency of International Concern (subject to prior consultation and notification); makes up to $50 million available for the Emergency Reserve Fund established in FY2017 (with modified terms substituting International Humanitarian Assistance for International Disaster Assistance and the Secretary of State for the USAID Administrator); and requires prior consultation with congressional committees and regular Appropriations Committee notifications for funds under this section. Finally, this section prohibits any funds made available by this Act from supporting the Wuhan Institute of Virology, EcoHealth Alliance, Inc.; any laboratory owned or controlled by the governments of China, Cuba, Iran, North Korea, Russia, Venezuela, or other foreign adversaries as determined by the Secretary of State; or gain-of-function research.

This section directs funds appropriated by this Act to promote the equality and empowerment of women and girls in U.S. diplomatic and development efforts worldwide, with specified allocations as follows: (1) $150 million from title III for women's economic empowerment, including expanding women-owned enterprises, improving property rights and access to financial services, enhancing women's role in economic decision-making, and implementing the Women's Entrepreneurship and Economic Empowerment Act of 2018 (P.L. 115-428), subject to consultation with the Appropriations Committees; (2) not less than $37.5 million from title III for the Madeleine K. Albright Women's Leadership Program to increase leadership opportunities for women in countries where they face discrimination due to law, policy, or practice; (3) not less than $187.5 million from titles III and IV to prevent and respond to violence against women and girls (including child marriage, rape, and female genital cutting and mutilation), with training for foreign police, judicial, and military personnel addressing such violence and trafficking in persons and promoting women's integration into security forces; and (4) $112.5 million from "National Security Investment Programs" and "International Narcotics Control and Law Enforcement" for a multi-year strategy on women, peace, and security to empower women in conflict prevention, peacebuilding, and reconstruction. This section also prohibits any funds appropriated by this Act from being made available for the Gender Equity and Equality Action Fund.

This section designates minimum funding levels for specified foreign assistance programs from appropriations under titles III and IV of the Act, as follows: (1) $691.5 million for the Nita M. Lowey Basic Education Fund (also for secondary education activities) and $121.6 million for multilateral education partnerships; (2) $203.25 million for higher education, including $50 million for programs authorized in prior law; (3) $274.313 million for biodiversity conservation and $89.063 million to combat wildlife poaching and trafficking (with restrictions on assistance to implicated foreign military units absent a U.S. national security interest); (4) $13.875 million from National Security Investment Programs for cooperative development; (5) $720 million from title III for food security and agricultural development under the Global Food Security Act of 2016, including $175 million for international agricultural research ($72 million for Feed the Future Innovation Labs); (6) $105.625 million from National Security Investment Programs and International Narcotics Control and Law Enforcement for programs to combat trafficking in persons (including $89.5 million from the latter account), with requirements for coordination with the State Department's Office to Monitor and Combat Trafficking in Persons, embassy training, restrictions on conferences in Trafficking in Persons Report Tier 3 countries, and a compliance report due 90 days after enactment; and (7) $338.25 million for water supply and sanitation projects ($169.125 million for sub-Saharan Africa). This section also authorizes the Secretary of State to deviate below these minimums by up to 20 percent for unforeseen circumstances, subject to congressional reporting.

This section prohibits the use of funds appropriated by this Act in contravention of Executive Order 14162—including for contributions, grants, or payments to the Green Climate Fund (i.e., UN fund providing climate finance to developing countries), Clean Technology Fund (i.e., multilateral fund for low-carbon technologies), or Loss and Damages Fund (i.e., fund established at COP27 for climate-related damages in vulnerable countries); to implement the Paris Agreement; or to support implementation of a carbon tax. The section further prohibits the Secretary of State from using such funds to impede uninterrupted hydrocarbon transmission by pipeline between the United States and Canada, as ratified by the 1977 U.S.-Canada Transit Pipelines Agreement.

This section requires departments, agencies, and organizations funded in titles I, II, III (Department of the Treasury and Independent Agencies), and VI to submit operating plans to the Committees on Appropriations not later than 45 days after enactment of this Act for funds appropriated in such titles or otherwise available for obligation in FY2027, including program-, project-, and activity-level details, comparisons to congressional budget justifications (CBJs) and directives, and justifications for any proposed changes, which are subject to reprogramming requirements under section 7015 of this Act. This section further requires (1) the Secretary of State to submit a spend plan not later than 180 days after enactment for specified assistance to Pacific Islands countries, Nigeria, Colombia, the Caribbean Basin Security Initiative, Central America Regional Security Initiative, Middle East Partnership Initiative, Indo-Pacific Strategy and Countering PRC Influence Fund, Power Africa, sections 7030, 7032, 7033, 7036, 7047(d) (country-by-country), 7059, and each subsection of 7060 of this Act, and International Narcotics Control and Law Enforcement demand reduction programs; and (2) the Secretary of the Treasury to submit a spend plan not later than 90 days after enactment for funds under “Department of the Treasury, International Affairs Technical Assistance” in title III and “Treasury International Assistance Programs” in title V of this Act. This section clarifies that such spend plans do not satisfy notification requirements in this Act or under section 634A of the Foreign Assistance Act of 1961. This section requires the FY2028 CBJ for national security, Department of State, and related programs to be submitted to the Committees on Appropriations concurrent with the President’s budget request, with appendices provided not later than 10 calendar days thereafter.

This section prohibits the use of funds appropriated by this Act, prior related appropriations acts, or any other act to implement specified reorganizations, redesigns, or plans by the Department of State or other funded federal entities without prior consultation with the appropriate congressional committees and notification to the Appropriations Committees, including a detailed justification (with prior fiscal year notifications satisfying the requirements). Such activities include (1) expanding, eliminating, consolidating, or downsizing covered departments, agencies, organizations, bureaus, or offices, including transfers of authorities and responsibilities; (2) expanding, eliminating, consolidating, or downsizing the U.S. official presence overseas at diplomatic facilities and other platforms; or (3) expanding or reducing the Department of State workforce—including permanent Civil Service, Foreign Service, eligible family member, and locally employed staff—from levels previously justified to the Appropriations Committees for FY2027.

This section subjects funds appropriated for the Department of State's Working Capital Fund for new service centers to the regular notification procedures of the Committees on Appropriations. This section requires the Secretary of State, not later than 45 days after the initial obligation of funds appropriated under titles III and IV for a bureau or office responsible for their management, to certify to the Committees on Appropriations that the bureau or office complies with Department and federal financial and grants management policies—considering its capacity to account for funds at the country and program level, identify risks and mitigation plans, establish performance measures, review activities, and assess results—and, if unable to certify, to submit a compliance plan and timeline. This section also— (1) authorizes credits to Diplomatic Programs of up to $5 million from fees for English teaching, library, motion pictures, publication, educational advising, counseling, and exchange visitor programs, and $15,000 from Blair House reimbursements, surcharges, and fees; (2) makes such funds available for passenger motor vehicle acquisitions and field examinations of title I programs; (3) permits up to $25 million of such funds for U.S. participation in international fairs and expositions abroad; (4) prohibits such funds from supporting special envoys, representatives, coordinators, advisors, or similar positions (including their personnel and managed funds) unless expressly authorized by statute or affirmatively receiving Senate advice and consent; and (5) authorizes public libraries organized as nonprofits to serve as passport acceptance facilities in FY2027, permitting them to collect and retain execution fees if compliant with State Department regulations.

This section authorizes additional uses of funds appropriated under title III of the Act (i.e., bilateral economic assistance programs under part I of the Foreign Assistance Act of 1961) as follows: (1) for costs of disaster surge capacity personnel (i.e., individuals focused on natural or man-made disaster response), subject to regular Appropriations Committee notification procedures; (2) for personal services agreements under 22 U.S.C. 2669(c); and (3) for excepted service appointments to address foreign crises or instability, provided such functions relate to appropriated purposes, with such funds in addition to amounts otherwise available and preservable for any original minimum funding requirements.

This section establishes the America First Opportunity Fund, making available up to $1,500,000,000 from funds appropriated under the headings "National Security Investment Programs," "International Narcotics Control and Law Enforcement," "Security Sector Programs," and "Foreign Military Financing Program" to provide assistance responding to crises, engaging proactively with strategic partners, and countering threats from adversaries. It (1) authorizes transfers of funds from the latter three accounts made available for the fund to, and merger with, funds under those headings, in addition to other transfer authorities and subject to Appropriations Committee notification; (2) makes such funds available until September 30, 2029; and (3) requires the Secretary of State to consult with the Appropriations Committees not later than 30 days prior to the initial obligation of funds.

This section prohibits the obligation or expenditure of funds appropriated by this Act for the Department of State and related programs for multiple purposes, including (1) flying or displaying flags over State Department facilities other than specified flags (i.e., U.S. flag, Foreign Service flag, POW/MIA flag, Hostage and Wrongful Detainee flag, state/insular area/D.C. flag at domestic locations, Indian Tribal government flag, U.S. agency branded flag, or sovereign flags of other countries); (2) programs, projects, or activities—including foreign public diplomacy—that teach or train specified concepts related to discrimination or adverse treatment based on race or sex, racial superiority, systemic racism or sexism, inherent racism or oppressiveness, moral character determined by race or sex, responsibility for past actions of one's race or sex group, or meritocracy as racist or sexist; (3) activities contravening Executive Order 14151 (Ending Radical and Wasteful Government DEI Programs and Preferencing); (4) activities contravening Executive Order 14170 (Reforming the Federal Hiring Process and Restoring Merit to Government Service, including hiring based on gender, religion, political affiliation, or race) or Executive Order 14173 (Ending Illegal Discrimination and Restoring Merit-Based Opportunity); (5) activities contravening Executive Order 14187 (Protecting Children From Chemical and Surgical Mutilation), including transfers to NGOs or programs offering counseling on, promoting, or conducting sex change surgeries, puberty blockers, or transgenderism for minors; (6) implementing, administering, or enforcing COVID-19 mask or vaccine mandates, including for international travel; (7) specified foreign assistance activities contravening Federal Register rules published January 27, 2026, on Combating Gender Ideology in Foreign Assistance (91 Fed. Reg. 3332) or Combating Discriminatory Equity Ideology in Foreign Assistance (91 Fed. Reg. 3345); (8) activities contravening Executive Order 14172 (Restoring Names That Honor American Greatness), including creating, procuring, or displaying maps inaccurately depicting the Gulf of America; and (9) discriminatory actions against persons acting in accordance with sincerely held religious or moral beliefs that marriage is or should be a union of one man and one woman, including adverse federal tax treatment, denial of deductions, grants, contracts, benefits, employment, or entitlements.

This section permanently rescinds unobligated balances from prior appropriations for Department of State and related programs as follows: (1) $458,100,000 from Consular and Border Security Programs; (2) $1,000,000,000 from International Disaster Assistance; and (3) $385,000,000 from the Millennium Challenge Corporation (i.e., an independent U.S. foreign aid agency that provides grants to low-income countries demonstrating good governance to promote economic growth and poverty reduction). It prohibits rescissions from amounts previously designated by Congress as emergency requirements pursuant to a concurrent resolution on the budget or specified provisions of the Balanced Budget and Emergency Deficit Control Act of 1985.

This section prohibits the use of funds appropriated by this Act or prior Acts for national security, Department of State, and related programs from supporting specified activities that deplatform, suppress, demonetize, or penalize lawful online speech in the United States (including coordination with social media companies, foreign governments or regulators, advertising ecosystems, or "disinformation"-related initiatives that impose costs on U.S. technology companies for First Amendment-protected speech), or from creating related blacklists. It permits such funds for investigating federal crimes (e.g., terrorism, espionage, child sexual abuse material) if not a pretext for prohibited conduct and requires the head of each funded department, agency, or organization to submit unclassified reports to the Appropriations Committees beginning 60 days after enactment of this Act and every 120 days thereafter until September 30, 2027, identifying related grants, contracts, compliance steps, and support for foreign digital regulations (with anonymization allowed for sensitive programs).

This section prohibits the use of funds in this Act to remove or waive sanctions imposed on an individual against whom credible allegations of child trafficking exist, as determined by the Office of Foreign Assets Control (OFAC) or a federal court of competent jurisdiction, unless the Secretary of State certifies in writing to the Committees on Appropriations at least 60 days in advance that such action is necessary for U.S. national security and provides written justification.
