H.R. 862 — TSA Commuting Fairness Act

This section directs the Administrator of the Transportation Security Administration (TSA) to submit to the House Committee on Homeland Security and the Senate Committees on Commerce, Science, and Transportation and Homeland Security and Governmental Affairs, not later than 270 days after enactment, a feasibility study on treating as on-duty hours the time TSA employees at airport locations spend traveling between regular duty locations and airport parking lots or bus and transit stops. In conducting the study, the Administrator must consider (1) the time needed for such travel at small hub, medium hub, and large hub airports (as defined in 49 U.S.C. §40102); (2) the average time such employees spend commuting, exclusive of such travel time; (3) potential benefits to such employees and TSA; (4) the feasibility of using mobile phones, location data, or other means for employees to report arrival at and departure from such parking lots and stops; (5) the estimated costs of treating such time as on-duty hours, including crediting such hours as basic pay for retirement purposes; and (6) other appropriate considerations.
