H.R. 8660 — Valuing Employee Stock Today Act

This section expresses congressional findings that the exemption from regular rate determinations for overtime under section 7(e)(8) of the Fair Labor Standards Act of 1938, as added by the Worker Economic Opportunity Act of 2000, was intended to be broad and flexible enough to cover various forms of employee equity compensation, and that restricted stock units should qualify for the exemption given their increased use since 2000.

This section expands the employer equity exemption from regular rate determinations under section 7(e)(8) of the Fair Labor Standards Act of 1938 to include restricted stock unit programs and revises related language from “exercise” to “exercise or acceptance.” The amendments take effect 90 days after the date of enactment of this Act.
