H.R. 871 — RULES Act

This section revises asylum application eligibility under the Immigration and Nationality Act by (1) limiting applications to aliens arriving only at ports of entry (from any alien physically present in or arriving at the United States, including those interdicted at sea), with no parole or release into the United States pending adjudication; (2) eliminating the one-year filing deadline and exceptions for changed or extraordinary circumstances; (3) barring applications by aliens apprehended after entering without inspection or who overstayed a period of authorized stay; and (4) retaining safe third country and prior denial exceptions (applicable to unaccompanied alien children only as to safe third country agreements). (Thus, asylum seekers crossing the border between ports of entry are ineligible.)
