H.R. 8727 — No Illegal Captivity and Extensions Act of 2026

This section eliminates the authority of the Secretary of Homeland Security to issue or enforce immigration detainers or holds. It strikes the provision in section 236(c)(3) of the Immigration and Nationality Act authorizing detention of aliens subject to detainers, strikes section 287(d) authorizing detainers for controlled substances violations, and bars the Secretary from conditioning intergovernmental service agreements on enforcement of detainers by other parties. It further prohibits the Secretary from issuing or enforcing any detainer or hold under the immigration laws through agreements or other instruments with Federal, State, or local law enforcement agencies.
