H.R. 8736 — Restoration of Employment Choice for Adults with Disabilities Act

This section revises the limitations on payment of subminimum wages to individuals with disabilities under section 511 of the Rehabilitation Act of 1973. It changes the prohibition to apply to individuals 18 or older (from 24 or younger), requires that the individual chooses to accept such employment, lowers the related age threshold in subsection (b)(2) to 17 (from 24), adds an exception allowing compliance when a designated state unit fails to provide required counseling after documented efforts by the entity, and directs that documentation of the transition process be provided to the employing entity when an individual is already employed at subminimum wage.
