H.R. 8768 — CHARGE Act

This section states congressional findings that China accounts for two thirds of the global electric vehicle market, that electric vehicles from China are expected to reach 8 percent of the U.S. market by 2030, and that 20 percent of new vehicle sales will require a connection to the electrical grid by that year. It further finds that remote software updates by vehicle manufacturers, combined with vehicle-to-grid connections, create risks of frequency and voltage deviations that could damage devices, enable coordinated disruptions, and amplify the effects of power outages, which already cost the United States $121 billion annually and reduce GDP by 1.3 percent, with a potential 2.6 percent GDP reduction from a three-day nationwide grid failure.

This section prohibits the sale, offer for sale, introduction or delivery into interstate commerce, or importation of any electric vehicle or motor vehicle equipment manufactured in whole or in part by a foreign entity of concern, or that uses a vehicle charge power control component manufactured in whole or in part by such an entity. The section defines “electric vehicle,” “foreign entity of concern,” and “vehicle charge power control component” for purposes of the prohibition.
