H.R. 916 — Rosa Parks Commemorative Coin Act

This section states congressional findings on the life, civil rights activism, arrest, and legacy of Rosa Parks, including her role in the Montgomery Bus Boycott, awards received, and state observances of Rosa Parks Day.

This section directs the Secretary of the Treasury to mint and issue coins in recognition of Rosa Parks: (1) up to 50,000 $5 gold coins weighing 8.359 grams, with a 0.850-inch diameter, and at least 90% gold; (2) up to 400,000 $1 silver coins weighing 26.73 grams, with a 1.500-inch diameter, and at least 90% silver; and (3) up to 750,000 half-dollar clad coins weighing 11.34 grams, with a 1.205-inch diameter, and minted to the specifications for half-dollar coins in 31 U.S.C. 5112(b). The section designates these coins as legal tender, as provided in 31 U.S.C. 5103, and as numismatic items for purposes of 31 U.S.C. 5134 and 5136.

This section requires designs for coins minted under this Act to be emblematic of Rosa Parks's legacy as a leader of the Civil Rights Movement, with at least one obverse design bearing her name and likeness, and mandates inscriptions on each coin of its value, the year 2029, “Liberty,” “In God We Trust,” “United States of America,” and “E Pluribus Unum.” It further directs the Secretary of the Treasury to select the designs after consultation with the Rosa and Raymond Parks Institute for Self Development and the Commission of Fine Arts, subject to review by the Citizens Coinage Advisory Committee.

This section establishes requirements for issuance of coins minted under the Act, including (1) issuance in uncirculated and proof qualities and (2) issuance only during calendar year 2029.

This section establishes the price for coins issued under the Act as their face value plus the surcharge under section 7(a) plus design and issuance costs (including labor, materials, dies, machinery use, overhead, marketing, and shipping); requires bulk sales at a reasonable discount; and authorizes acceptance of prepaid orders at a reasonable discount before issuance.

This section establishes surcharges on sales of coins minted and issued under this Act—$35 per $5 coin, $10 per $1 coin, and $5 per half-dollar coin—with all proceeds paid promptly to the Rosa and Raymond Parks Institute for Self Development to support youth development and civil rights education and advocacy. The section subjects the institute to specified audit requirements (under 31 U.S.C. 5114(f)(2)). It further prohibits surcharges on any such coin issued in a calendar year if the issuance would cause the number of commemorative coin programs for that year to exceed the annual limit of two (under 31 U.S.C. 5112(m)(1)), and authorizes the Secretary to issue related guidance.

This section requires the Secretary to ensure that (1) minting and issuing coins under this Act results in no net cost to the U.S. government; and (2) no funds, including surcharges, are disbursed to recipients designated in section 7(b) until the Treasury recovers all costs of designing and issuing the authorized coins (i.e., labor, materials, dies, machinery use, winning design compensation, overhead expenses, marketing, and shipping).
