H.R. 920 — Federal Initiative to Guarantee Health by Targeting Fentanyl Act

This section adds to Schedule I of the Controlled Substances Act a new category for fentanyl-related substances—defined as any material, compound, mixture, or preparation containing any quantity of substances structurally related to fentanyl via specified modifications (e.g., replacement or substitution on the phenethyl, piperidine, aniline ring, or N-propionyl group), including their salts, isomers, and salts of isomers unless exempted or listed elsewhere. (As background, Schedule I substances have high abuse potential, no accepted medical use in the United States, and lack accepted safety under medical supervision.) The section further eliminates any mandatory minimum term of imprisonment otherwise required under CSA §401(b)(1)(C) (i.e., for trafficking 28 grams or more but less than 1 kilogram of a mixture containing a Schedule I or II substance). (Thus, sentences for these fentanyl-related substances may fall below the previous 5-year minimum.)
