H.R. 932 — Protecting VA Employees Act

This section repeals the Department of Veterans Affairs' expedited authority to remove, demote, or suspend certain senior executives and Title 38 employees (38 U.S.C. §714(a)-(d), (g)), including the 15-business-day aggregate timeline for notice, response, and decision (with a 7-business-day response period). (Thus, such employees are subject to standard civil service procedures under chapters 43 and 75 of title 5, U.S. Code, including performance-based actions and adverse action appeals to the Merit Systems Protection Board; the section is redesignated as §734 with the heading "Protections for whistleblowers from removal, demotion, and suspension.")

This section restores specified disciplinary and grievance procedures for Veterans Health Administration (VHA) personnel to their pre-2017 versions—prior to enactment of the Department of Veterans Affairs Accountability and Whistleblower Protection Act of 2017 (P.L. 115-41)—by amending (1) 38 U.S.C. §7461(b), relating to major adverse actions; (2) §7462(b), relating to investigations and other inquiries; and (3) §7463(c), relating to grievance procedures. (Thus, these subsections revert to prior due process requirements applicable to VHA title 38 employees.)
