H.R. 942 — Banning SPR Oil Exports to Foreign Adversaries Act

This section establishes a prohibition on the export or sale of petroleum products drawn from the Strategic Petroleum Reserve (SPR)—a Department of Energy stockpile of crude oil and refined products for use during energy supply disruptions—to the People's Republic of China, Democratic People's Republic of Korea, Russian Federation, Islamic Republic of Iran, or any entity owned or controlled by those countries or the Chinese Communist Party. (Thus, SPR drawdowns cannot supply adversaries absent a waiver.) It authorizes the Secretary of Energy to waive the prohibition upon certifying the export or sale is vital to U.S. national security interests and directs the Secretary to issue an implementing rule within 60 days of enactment. It also makes conforming amendments to (1) the SPR drawdown and sale authority under section 161(a) of the Energy Policy and Conservation Act (EPCA), (2) the EPCA table of contents, and (3) the national policy on crude oil export restrictions (42 U.S.C. 6212a(b)) to except EPCA section 164.
