H.R. 96 — Buzz Off Act

This section prohibits a federal law enforcement agency from using an unmanned aerial vehicle (UAV) to intentionally conduct surveillance of, gather evidence or information about, or photographically or electronically record a specifically targeted U.S. citizen or the citizen's private property. An exception permits such UAV use to photograph or record a U.S. citizen for public dissemination if the agency obtains the citizen's written consent. The prohibition does not apply if (1) the President, acting through the Secretary of Homeland Security, authorizes UAV surveillance upon the Secretary's written certification under oath that it is necessary to counter a high risk of terrorist attack by a specific individual or organization; or (2) the agency head obtains a search warrant signed by a judge authorizing UAV use.
