H.R. 962 — Defending Veterans’ Second Amendment Rights Act

This section prohibits the Secretary of Veterans Affairs from transmitting to the Department of Justice, for use by the National Instant Criminal Background Check System (NICS) established under section 103 of the Brady Handgun Violence Prevention Act (i.e., the federal system that conducts background checks to prevent prohibited persons from purchasing firearms), personally identifiable information on veterans and other beneficiaries solely on the basis of a determination under chapter 11 of title 38, U.S. Code, that a person has a service-connected disability. (As background, such determinations involve VA ratings of disabilities incurred or aggravated in military service; current VA practice reports to NICS only those veterans adjudicated mentally incompetent with a fiduciary appointed, not all with service-connected disabilities.)
