H.R. 98 — End Endless Criminal Statutes Act

This section states congressional findings that 10 specified actions (e.g., writing a check for less than $1; selling or possessing colored oleomargarine or margarine unless packaged, labeled, or served in a triangular shape; sledding on Capitol grounds when prohibited) may unnecessarily carry criminal penalties under federal statutes.

This section repeals certain federal criminal provisions and strikes language from others as follows: (1) repeals 18 U.S.C. §336; (2) repeals subsections (b), (c), and (d) of section 407 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. §347); (3) repeals section 1 of the Act of March 3, 1927 (7 U.S.C. §491); (4) strikes from 18 U.S.C. §1720 the clause prohibiting whoever unlawfully and willfully removes from any mail matter any stamp attached thereto in payment of postage; (5) strikes "or of original design" from 18 U.S.C. §486; (6) strikes the second sentence of 46 U.S.C. §11110; (7) repeals 18 U.S.C. §2279; (8) repeals 18 U.S.C. §1725; (9) repeals the Act entitled "An Act to protect the public property, turf, and grass of the Capitol Grounds from injury" (2 U.S.C. §1963).

This section revises the prohibition on non-letter carriers wearing a Postal Service-prescribed uniform or badge (18 U.S.C. 1730) by (1) requiring intent to commit an offense under chapter 83 of title 18, United States Code (i.e., offenses relating to the Postal Service), and (2) striking the exception for actors or actresses portraying letter carriers in theatrical, television, or motion-picture productions. The maximum penalty remains a fine under title 18 or imprisonment for not more than six months, or both.
