H.R. 99 — Protecting Businesses From Frivolous COVID Lawsuits Act of 2025

This section requires courts in federal civil actions alleging negligence arising from COVID-19 transmission to instruct juries that (1) the liability standard is the reasonable person standard, (2) a person is negligent if they do something a reasonably careful person would not do or fail to do something they would do in the same situation, (3) opening a business by itself is reasonable as a matter of law, and (4) negligence may not be found solely on the basis of holding oneself open for business. (Thus, businesses cannot be found negligent solely for operating during the COVID-19 pandemic.)
