H.Res. 1058 — Recognizing that it is the duty of the Federal Government to develop and implement a Transgender Bill of Rights to protect and codify the rights of transgender and nonbinary people under the law and ensure their access to medical care, shelter, safety, and economic security.

This section expresses the sense of the House of Representatives that the Federal Government has a duty to protect the rights of transgender and nonbinary people by implementing a Transgender Bill of Rights that includes— (1) ensuring equal access to services and public accommodations aligning with gender identity by amending the Civil Rights Act of 1964 to prohibit discrimination on the basis of sex, including gender identity and sex characteristics, in public accommodations and federally funded programs and activities, expanding the definition of public accommodation, clarifying that discrimination on religious grounds is illegal, and amending Federal law to protect students from such discrimination in classes, extracurriculars including athletics, facilities, and other school activities; (2) clarifying the right to bodily autonomy and health care by enforcing prohibitions against discrimination in health care on the basis of actual or perceived gender identity or sex characteristics, eliminating governmental restrictions on gender-affirming medical care and counseling for adults and adolescents, protecting providers from penalties or discipline, protecting children from removal from supportive homes, protecting providers of gender-affirming, reproductive, and abortion care from violence, expanding access to competent providers and telehealth in rural and underserved areas, codifying the right to abortion and reproductive health care including contraceptives and assistive reproductive technology, banning nonconsensual surgeries on intersex children and infants, banning conversion practices, protecting providers from fraud accusations, and ensuring the Sexual & Gender Minority Research Office at the National Institutes of Health remains operational; (3) ensuring the ability to care for themselves and their families by codifying Bostock v. Clayton County through amendments to title VII of the Civil Rights Act of 1964, the Fair Housing Act, and the Equal Credit Opportunity Act to prohibit discrimination on the basis of actual or perceived gender identity or sex characteristics; and (4) providing accessible avenues for legal recognition and civil participation by eliminating unnecessary Federal gender identification requirements on government documents, eliminating barriers to updating sex and names on passports, Social Security cards, and other Federal records on self-attestation where possible, requiring an X marker on Federal identification and records, requiring States to permit same-day updates to voter registration and voting in Federal elections, clarifying that Federal statutes prohibiting sex discrimination in jury service also prohibit discrimination based on gender identity and sex characteristics, eliminating anti-trans bias in the immigration and asylum systems through culturally competent training, ensuring transgender and nonbinary servicemembers can serve in the Armed Forces, and requiring the TRICARE program (as defined in section 1072 of title 10, United States Code) and the Department of Veterans Affairs to pay for gender.
