H.Res. 1078 — Of inquiry requesting the President and directing the Secretary of Health and Human Services to transmit, respectively, certain documents to the House of Representatives relating to the "Defend the Spend" freeze on child care payments to all States, Tribes, and Territories.

This section requests the President and directs the Secretary of Health and Human Services to transmit to the House of Representatives, not later than 14 days after adoption of the resolution, copies of any documents in their possession relating to the December 30, 2025, tweet by HHS Deputy Secretary Jim O’Neill freezing all Administration for Children and Families (ACF) payments and reinstituting Defend the Spend procedures; drawdowns of Child Care Entitlement to States (CCES) allocations under section 418 of the Social Security Act after that date; payment management system delays and procedures for title IV and subtitle A of title XX entitlement funding after April 15, 2025; HHS and ACF social media posts alleging child care fraud and resulting threats to providers after December 30, 2025; warning letters, Inspector General referrals, and disciplinary actions for alleged misuse of title IV funds between January 20 and December 1, 2025; grantee data submission requirements and data storage or sharing after April 15, 2025; payments to contractors for Defend the Spend implementation affecting title IV funds; legal opinions classifying related contracting and spending information as proprietary; contracts, staffing assignments, and instructions to HHS staff on Defend the Spend criteria for subtitle A of title IV entitlements; contracts with States, Tribes, and Territories for 2025 and 2026 payment management systems; and meetings or actions involving the HHS Office of the General Counsel on payment system access and funding delays after January 20, 2025.
