This section sets forth Article I of the impeachment resolution against President Donald John Trump for obstruction of justice, violation of due process, and breach of the duty to faithfully execute the laws. The section states that the President abused the powers of the office by (1) directing Department of Justice subordinates and attorneys to make misleading and false representations to courts, including by seeking to dismiss bribery and fraud charges against New York City Mayor Eric Adams in a quid pro quo for cooperation with administration priorities and by terminating career attorneys in retaliation for their work on matters including the January 6, 2021, attack on the United States Capitol; (2) defying binding court orders by removing individuals to El Salvador, including Kilmar Armando Abrego Garcia despite a withholding of removal order and subsequent Supreme Court rulings requiring facilitation of his release and provision of information, as well as by conducting enforced disappearances without due process or disclosure to families and counsel; and (3) violating federal laws by terminating inspectors general without following the process in the Inspector General Act of 1974, terminating a Merit Systems Protection Board member, and unlawfully transmitting sensitive personal information in violation of the Privacy Act and the Administrative Procedure Act.

This section sets forth Article II of the articles of impeachment against President Donald John Trump for usurpation of the appropriations power. The article charges that the President violated the Constitution and the Impoundment Control Act of 1974 by directing the withholding of congressionally appropriated funds and attempting to dismantle federal agencies, including the following: (1) directing the dismantling of the Department of Education, established by the Department of Education Organization Act to distribute federal aid to students and institutions and prohibit discriminatory practices, through Executive Order 14242; (2) unlawfully directing the elimination of the United States Agency for International Development (USAID), created under the Foreign Assistance Act of 1961 to deliver foreign assistance including disaster relief, global health programs, and food security initiatives; and (3) creating the Department of Government Efficiency (DOGE) to impose payment holds and rescind funds after disbursement to agencies including the National Institutes of Health, the Federal Aviation Administration, and the Department of Veterans Affairs.

This section establishes the charge that President Donald John Trump created an unlawful office, the Department of Government Efficiency (DOGE), through executive orders and directives without statutory authorization or congressional funding, and designated Elon Musk as its de facto head without Senate confirmation as a principal officer or proper vesting of appointment authority for an inferior officer. The section states that Musk was improperly designated a special government employee, exercised control over multiple agencies, and directed actions including (1) impoundment of funds appropriated by Congress, (2) violations of privacy and security laws involving sensitive information systems and classified material, and (3) termination of federal employees in violation of civil service laws. It further alleges that false representations regarding DOGE leadership were made to courts, contrary to public statements by the President and Administration, including the March 4, 2025, address to Congress.

It asserts that he abused the powers of the Presidency by engaging in a pattern of unlawful corruption for personal profit, including soliciting and accepting bribes in exchange for official actions and policy influence; creating cryptocurrency tokens through pump-and-dump schemes that served as conduits for bribes; extracting large payments via settlements in meritless personal litigation by leveraging threats of government action; soliciting and receiving $940,000,000 in pro bono legal services from law firms; refusing to divest from personal business ventures that created conflicts of interest; permitting subordinates, relatives, and associates to violate ethics and disclosure laws; and soliciting payments from foreign governments in violation of the constitutional prohibition on foreign emoluments.

This section (Article VII) charges President Donald John Trump with high crimes and misdemeanors for seeking to establish himself as a tyrant by usurping constitutional powers of Congress, courts, and states; violating the presidential oath and duty to faithfully execute laws; denying rights to free speech, assembly, petition, due process, equal protection, and counsel; intimidating and coercing Members of Congress and state officials through threats of prosecution and violence; abrogating the 14th Amendment citizenship clause via executive order; and threatening the 22nd Amendment presidential term limits.
