H.Res. 5 — Adopting the Rules of the House of Representatives for the One Hundred Nineteenth Congress, and for other purposes.

This section adopts the rules of the House of Representatives of the One Hundred Eighteenth Congress—including applicable provisions of law or concurrent resolutions that constituted rules at the end of that Congress—as the rules of the One Hundred Nineteenth Congress, with amendments to the standing rules as provided in section 2 and other orders as provided in this resolution.

This section amends House standing rules in multiple ways, as follows: (1) In rule IX, clause 2(a), requires that a privileged resolution declaring a vacancy in the Office of Speaker be offered by a majority party member with eight majority party cosponsors. (2) In rule XI, authorizes committees to permit electronic voting pursuant to regulations by the chairs of the Committees on Rules and House Administration (and makes conforming changes to clause 1(d)(2)(E)). (3) In rule II, clause 4, requires the Chief Administrative Officer to assist the Clerk with responsibilities for vacant offices (as described in clause 2(i)). (4) Throughout the rules, changes all references from "Committee on Oversight and Accountability" to "Committee on Oversight and Government Reform". (5) In rule X, clauses 1(e) and 3(d), changes all references from "Committee on Education and the Workforce" to "Committee on Education and Workforce". (6) In rule II, strikes clause 9 establishing the Office of Diversity and Inclusion (and makes conforming amendments in rule X, clause 4(d)(1)(A)). (7) Codifies prior separate orders, including (A) in rule XII, clause 3, procedures for memorials on Article V constitutional conventions or rescissions (designation by Judiciary chair for public availability by Clerk, organized by state and year); (B) in rule XII, clause 7, reservation of bill numbers H.R. 1–10 for Speaker and H.R. 11–20 for Minority Leader; and (C) in rule I, a new clause 13 authorizing Speaker-designated district work periods (with automatic Journal approval, adjournment authority, Chair appointments, and exclusions from specified calendar/legislative day counts under the War Powers Resolution and various rules). (8) In rule XXIII, replaces gender-neutral family terms with specific relations (e.g., in clause 8(c)(3), "parent, child, sibling..." to "father, mother, son, daughter..."; in clause 15(d)(2), similar changes). (9) In rule XV, clause 1(a), limits Speaker consideration of motions to suspend the rules to Mondays, Tuesdays, and Wednesdays. (10) Makes technical corrections, including in rule X, clause 7(b) (removing session-specific language for interim funding) and rule XIII, clause 6(d) (inserting "thereafter" after "seven legislative days").

This section establishes separate orders for the One Hundred Nineteenth Congress that (1) expand the Holman Rule under clause 2 of rule XXI to allow amendments (offered after a bill has been read for amendment) retrenching expenditures by reducing amounts in the bill, the number and salary of U.S. officers, or compensation paid from the Treasury; (2) authorize en bloc amendments during the reading of general appropriation bills for amendment to transfer appropriations to a required "spending reduction account" (defined as the last section of such a bill reciting the amount by which the bill's new budget authority is below the applicable section 302(b) allocation or $0 if no allocation is in effect), while prohibiting other amendments to that account and waiving certain points of order against it; and (3) direct the Congressional Budget Office, as applicable, to analyze long-term direct spending increases (imposing a point of order against reported bills, amendments, or conference reports causing a net increase exceeding $2.5 billion in any of four consecutive 10-fiscal-year periods beginning 10 fiscal years after the current fiscal year, with levels determined by the Budget Committee chair), exclude conveyances of federal land to states, localities, or tribes from scoring as new budget authority or outlay increases, include inflationary impact estimates for legislation with mandatory spending changes equaling or exceeding 0.25% of current fiscal-year GDP, and provide specified content in CBO analyses for legislation affecting the Federal Hospital Insurance Trust Fund or Old-Age, Survivors, and Disability Insurance Trust Fund.

This section applies prior House resolutions establishing certain committees, commissions, and offices to the 119th Congress, with specified modifications. **(a) Select Committee on the Strategic Competition between the United States and the Chinese Communist Party.** Applies H.Res. 11 (118th Congress), as amended by H.Res. 78, except that the committee must submit all reports and policy recommendations by December 31, 2026, and its jurisdiction is limited to policy recommendations on countering the economic, technological, security, and ideological threats posed by the Chinese Communist Party to the United States and its allies and partners. **(b) House Democracy Partnership.** Applies H.Res. 24 (110th Congress), except that the commission is renamed the House Democracy Partnership. **(c) Tom Lantos Human Rights Commission.** Applies sections 1 through 7 of H.Res. 1451 (110th Congress), except that (1) the commission may collaborate with professional staff of committees other than Foreign Affairs; (2) it may use all resources the Committee on Foreign Affairs is authorized to obtain from other House offices; and (3) any authorized funding for its full-time staff and resources is separate from, and in addition to, the Committee on Foreign Affairs' salaries and expenses, must be administered by that committee, and must be distributed equally between the co-chairs. **(d) Office of Congressional Conduct.** (1) Construes all standing rules references to the Office of Congressional Ethics as references to the Office of Congressional Conduct. (2) Applies section 1 of H.Res. 895 (110th Congress), except that the office is renamed the Office of Congressional Conduct; references to the Office of Congressional Ethics are construed accordingly; it is treated as a standing committee for purposes of section 202(i) of the Legislative Reorganization Act of 1946; references to the Committee on Standards of Official Conduct are construed as references to the Committee on Ethics; requirements for board concurrence are changed to consultation; subjects of reviews must be informed of their right to counsel, which may not be held against them; the office may not deny constitutional rights; board members serving terms exceeding limits are removed; and staff appointment and compensation requires an affirmative vote of at least four board members within 30 days of the board's full constitution.

This section provides for the expedited consideration in the House of 12 specified bills—H.R. 28 (Title IX athletics based on reproductive biology and genetics at birth); H.R. 29 (DHS custody of aliens charged with theft); H.R. 30 (sex offenses/domestic violence grounds of inadmissibility/deportability); H.R. 31 (assault of law enforcement officer as deportable offense); H.R. 32 (federal funds ineligibility for sanctuary jurisdictions benefiting unlawfully present aliens); H.R. 35 (penalties for fleeing federal officer in motor vehicle); H.R. 21 (health care practitioner care for child surviving abortion); H.R. 23 (sanctions on International Criminal Court for actions against U.S./allied protected persons); H.R. 33 (tax rules for certain Taiwan residents with U.S. income); H.R. 22 (proof of U.S. citizenship for federal voter registration); H.R. 27 (fentanyl-related substances scheduling under Controlled Substances Act); and H.R. 26 (prohibition on hydraulic fracturing moratorium)—upon adoption of the resolution. All points of order against consideration of the bills or their provisions are waived; each bill is considered as read; and the previous question is ordered on the bill and any amendments thereto to final passage without intervening motion except (1) one hour of debate equally divided and controlled by the Majority Leader and Minority Leader or their designees and (2) one motion to recommit.
