H.Res. 802 — Requiring the House of Representatives to convene and hold recorded quorum calls during a Government shutdown, and for other purposes.

This section requires the Speaker of the House of Representatives to convene a meeting of the House on each day of a government shutdown. It prohibits consideration of a motion to adjourn or declaration of a recess on such a day unless (1) the House has met for each of the first five consecutive calendar days of the shutdown, (2) the proposed adjournment or recess does not exceed two consecutive calendar days, and (3) the House has met for at least five consecutive calendar days since the most recent such adjournment or recess.

This section requires one or more recorded quorum calls each day the House is in session during a government shutdown, with each Member recording presence electronically. It further directs the Sergeant-at-Arms to impose fines of $500 (first offense) or $2,500 (subsequent offense) on a Member failing to record presence for two or more consecutive days (except due to the Member's or family member's illness); requires notifications to specified officials with public availability by the Committee on Ethics chair; provides for Member appeals to the Committee on Ethics within 30 calendar days or five legislative days (whichever later), with the fine upheld unless a majority of the committee agrees otherwise; mandates deduction of unpaid fines from a Member's salary after 90 calendar days; prohibits use of campaign or official funds (including Members' Representational Allowance) to pay fines; and authorizes relevant officers and committees to establish implementation policies and procedures.

This section clarifies that nothing in the resolution prohibits or otherwise affects the House of Representatives' authority to conduct any business consistent with House Rules during a government shutdown.

This section defines a government shutdown, for purposes of this resolution, as a lapse in appropriations for any federal agency or department resulting from the failure to enact a regular appropriations bill or continuing resolution.
