H.Res. 988 — Providing for consideration of the bill (H.R. 2988) to amend the Employee Retirement Income Security Act of 1974 to specify requirements concerning the consideration of pecuniary and non-pecuniary factors, and for other purposes; providing for consideration of the bill (H.R. 2262) to amend the Fair Labor Standards Act of 1938 to exclude certain activities from hours worked, and for other purposes; providing for consideration of the bill (H.R. 2270) to amend the Fair Labor Standards Act of 1938 to exclude child and dependent care services and payments from the rate used to compute overtime compensation; providing for consideration of the bill (H.R. 2312) to amend the Fair Labor Standards Act of 1938 to revise the definition of the term ''tipped employee'', and for other purposes; and providing for consideration of the bill (H.R. 4366) to clarify the treatment of 2 or more employers as joint employers under the National Labor Relations Act and the Fair Labor Standards Act of 1938.

This section establishes a special rule for House floor consideration of H.R. 2988, which amends the Employee Retirement Income Security Act of 1974 (ERISA) to specify requirements for considering pecuniary and non-pecuniary factors in retirement investment decisions. It waives all points of order against consideration of the bill and its provisions; deems the Committee on Education and Workforce's amendment in the nature of a substitute as adopted and the bill as read; and orders the previous question on the bill, as amended, to final passage without intervening motion except (1) one hour of debate equally divided and controlled by the committee chair and ranking minority member or designees; (2) one further amendment printed in part A of the Committee on Rules report, if offered by the designated Member, which shall be considered as read, separately debatable for the time specified in the report equally divided between proponent and opponent, and not subject to a division of the question; and (3) one motion to recommit.

This section makes in order consideration of H.R. 2262 in the House—which amends the Fair Labor Standards Act of 1938 to exclude certain activities from hours worked—upon adoption of the resolution. It waives all points of order against the bill and its provisions; deems as adopted a modified amendment in the nature of a substitute recommended by the Committee on Education and the Workforce and deems the bill as read; and orders the previous question to final passage after (1) one hour of debate equally divided and controlled by the chair and ranking minority member of the Committee on Education and the Workforce (or designees) and (2) one motion to recommit.
