S. 1010 — CAMPUS Act

This section directs the Director of National Intelligence, in consultation with the Secretary of Defense, to identify each institution of higher education domiciled in the People's Republic of China that provides support to the People's Liberation Army, including through implementation of the Military-Civil Fusion strategy or participation in the defense industrial base of the People's Republic of China. Not later than 180 days after enactment of this Act, and annually thereafter, the Director must submit a list of such entities to the appropriate congressional committees.

This section prohibits the Department of Defense from providing any research, development, testing, and evaluation (RDT&E) funds to an entity that maintains a contract with an institution identified under section 2.

This section prohibits the Director of the Defense Counterintelligence and Security Agency from determining that a facility of an entity is eligible to host or store classified information unless the entity certifies that it has no active research partnership with an institution on the list submitted under section 2(b).

This section authorizes the Secretary of State to deny nonimmigrant F (student) or J (exchange visitor) visas to students or employees of an institution identified under section 2.

This section prohibits the Department of Education from providing any funds authorized to be appropriated or otherwise made available for K-12 education to an elementary or secondary school that maintains a contract with an entity domiciled in the People's Republic of China.

This section expresses the sense of Congress that the American Institute in Taiwan should strengthen partnerships with the Taipei Economic and Cultural Representative Office in the United States to expand U.S. students' access to Mandarin language instruction and Chinese cultural programming, including in K-12 schools and institutions of higher education. The section authorizes the Secretary of Education to award grants to such schools and institutions for Mandarin language instruction and Chinese cultural programming provided through those partnerships, including under the United States-Taiwan Education Initiative.

This section prohibits funds authorized for research, development, testing, and evaluation from being provided to an entity that maintains a contract with an entity domiciled in the People's Republic of China identified on the list required under section 2(b) or on the Entity List maintained by the Bureau of Industry and Security at the Department of Commerce (Supplement No. 4 to part 744 of title 15, C.F.R.). (The Entity List identifies foreign entities subject to U.S. export license requirements for national security reasons.)

This section establishes definitions for purposes of this Act, including (1) "appropriate committees of Congress" as specified Senate and House committees on Armed Services, Intelligence, and Health, Education, Labor, and Pensions (Senate) or Education and the Workforce (House); (2) "institution of higher education domiciled in the People's Republic of China" as an institution under the control or supervision of the Ministry of Education or the State Administration of Science, Technology, and Industry for National Defense of the People's Republic of China; and (3) "K–12 education" as having the meaning given in section 5002(10) of the National Artificial Intelligence Initiative Act of 2020 (15 U.S.C. 9401(10)) (i.e., elementary and secondary school education provided by local educational agencies).
