S. 1025 — FCC Legal Enforcement Act

This section amends the Communications Act of 1934 to authorize the Federal Communications Commission (FCC) to commence and supervise litigation, and to prosecute, unpaid forfeiture penalties imposed for violations of the Telephone Consumer Protection Act (TCPA; 47 U.S.C. 227)—which restricts use of automatic telephone dialing systems, artificial or prerecorded voices, and unsolicited fax advertisements—if the Attorney General does not act within 120 days of the FCC's referral. It further directs the FCC to prioritize enforcement of such TCPA penalties exceeding $25 million.

This section modifies the requirement for the Federal Communications Commission (FCC) to prescribe regulations implementing restrictions on robocalls and autodialed calls under the Telephone Consumer Protection Act (TCPA) by adding that such regulations shall be prescribed as necessary in the judgment of the Commission to protect subscribers from unwanted calls.
