S. 1032 — Major Richard Star Act

This section authorizes concurrent receipt of military retired pay and veterans' disability compensation without offset under 38 U.S.C. §§5304-5305 for members retired under chapter 61 of title 10, U.S. Code (i.e., medical disability retirees), who have a combat-related disability (as defined in 10 U.S.C. §1413a(e)). (Thus, such retirees previously subject to offset may now receive both benefits in full.) The section further revises combat-related special compensation (CRSC) provisions under 10 U.S.C. §1413a(b)(3) to eliminate retired pay offsets for CRSC-eligible retirees with 20 or more years of creditable service, including chapter 61 retirees. It also makes technical amendments to 10 U.S.C. §1414 by (1) striking obsolete phase-in provisions for concurrent retirement and disability pay (CRDP) from 2004-2013, (2) redesignating subsections, (3) updating the section heading to "Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt," and (4) conforming related references. The amendments apply to payments for months beginning on or after the first day of the first month following enactment.
