This section defines, for purposes of the Act, (1) Administrator as the Administrator of the Southwestern Power Administration, (2) Fund as the Southwestern Power Administration Fund established by section 3(a), and (3) Secretary as the Secretary of Energy.
This section establishes in the Treasury of the United States the Southwestern Power Administration Fund—a revolving fund for the Southwestern Power Administration (SPA), one of four federal Power Marketing Administrations under the Department of Energy that markets wholesale hydropower from specified reservoir projects (as authorized by the Flood Control Act of 1944, 16 U.S.C. 825s)—consisting of (1) SPA receipts and collections (including trust funds), (2) appropriations, (3) transfers of unexpended balances from three prior funds established by appropriations acts in 1949 (16 U.S.C. 825s-1), 2005 (16 U.S.C. 825s-4), and 2010 (16 U.S.C. 825s-7), and (4) specified deposits from the 2005 act; makes amounts in the fund available until expended; and authorizes SPA to use fund amounts for operation and maintenance of transmission facilities, power and energy marketing, construction and acquisition of transmission lines and related facilities, and administrative expenses. The section further authorizes SPA to incur obligations in advance of appropriations (to be liquidated from the fund), requires annual transfer of excess fund amounts to the Treasury as miscellaneous receipts, and applies specified government corporation laws (31 U.S.C. ch. 91) to SPA's fund administration. Finally, it amends the 2005 appropriations act proviso to redirect deposits to the new fund (effective on enactment) and repeals the 2010 act provisos establishing the offsetting collections fund.
