S. 1045 — Aviation Funding Stability Act of 2025

This section establishes automatic funding from the Airport and Airway Trust Fund for Federal Aviation Administration (FAA) programs—including Operations (air traffic control and safety oversight), Facilities and Equipment (air navigation infrastructure), Research, Engineering, and Development, and Grants-in-Aid for Airports (i.e., Airport Improvement Program grants)—during lapses in appropriations, at the prior fiscal year's rate as provided in the prior year's regular appropriation act or continuing resolution. Such funding is available from the first day of a lapse until a new regular appropriation act or continuing resolution becomes law (or longer if in effect at fiscal year-end), subject to the prior year's terms and conditions, with obligations charged to subsequent appropriations; the section also amends IRC §9502(d)(1)(A) to authorize these expenditures under the Aviation Funding Stability Act of 2025 and does not apply if other law provides or prohibits such funding. (Thus, the FAA can maintain uninterrupted operations, avoiding air traffic disruptions during government shutdowns.)
