S. 1072 — Stop CARB Act of 2025

This section repeals CAA §209(b), which authorizes EPA to waive federal preemption to allow California (and other states adopting California's standards) to set motor vehicle emission standards; nullifies all waivers issued before enactment; and denies all pending waiver applications. It prohibits states or their subdivisions from adopting or enforcing emission standards for new nonroad engines or vehicles, including those used in construction equipment, construction vehicles, farm equipment, farm vehicles, locomotives, or locomotive engines. It also makes conforming amendments to CAA §§202(i), 211(c), (k), and (o), 241(2), 242(b), 243(e)-(g), 244, and 247(b) by removing references to the repealed waiver authority.

This section repeals the authorization in Clean Air Act Section 177 for states other than California to adopt and enforce identical California new motor vehicle emission standards (i.e., those for which EPA has granted California a waiver under CAA Section 209), provided the standards are adopted at least two years before the model year. (Thus, after enactment, such states may no longer require new motor vehicles or engines to meet standards exceeding federal requirements, except through other limited authorities.) It also makes a conforming amendment to CAA Section 249 by striking a reference to Section 177.
