S. 1092 — WIPPES Act

This section requires covered entities to label covered products (i.e., certain wipes) with a specified symbol and label notice indicating non-flushability, in a clear and conspicuous manner reasonably visible to users—including requirements tailored to packaging type such as cylindrical (at least 8% of flip-lid surface area if applicable), flexible film, rigid refillable tubs, bulk, and combined products (with exemptions for small packages under 3 by 3 inches and certain outer packaging)—with the symbol and notice each comprising at least 2% of the principal display panel surface area and in high contrast. It prohibits covered entities from making any express or implied representations that covered products can or should be flushed. The section treats violations as unfair or deceptive acts or practices under FTC rulemaking authority (15 U.S.C. 57a(a)(1)(B)), enforceable by the Federal Trade Commission using its standard powers; directs the Commission to issue non-binding compliance guidance within 180 days of enactment, in consultation with specified agencies; and preserves other Commission authorities.
