This section revises the process for determining state compliance with transportation asset management plan (TAMP) requirements under the National Highway Performance Program (NHPP)—which supports state development and implementation of plans to improve the condition and performance of system assets while minimizing costs—as follows: (1) changes the frequency of compliance determinations from each fiscal year to once every 4 years, in conjunction with recertification under paragraph (6)(B); (2) specifies that compliant determinations apply until the next recertification and noncompliant determinations apply until the Secretary finds compliance; (3) requires states to submit supporting information with recertification submissions, deeming them sufficient if covering the most recent year plus certifications that prior years met requirements; and (4) for noncompliant states, requires the Secretary to provide a written statement of needed actions and at least 90 days to cure deficiencies (extendable on request), during which penalties and other impacts are stayed. This section also authorizes the Secretary to extend cure periods for recertification denials (previously unspecified), including stays of penalties and other impacts.
