S. 1170 — Taxpayer-Funded Union Time Transparency Act

This section establishes an annual reporting requirement for the head of each agency (as defined in 5 U.S.C. §7103(a)(3)), with the first report due by June 30 of the year after enactment of this Act and each June 30 thereafter, to detail agency costs related to official time (i.e., paid work time for union representational activities under 5 U.S.C. §7131) and other labor-management activities for the prior year—with each report submitted to Congress and posted on the agency's public website. The report must include (1) total cost of official time; (2) explanations of each authorization's purpose; (3) for each employee on official time, position, basic pay rate, bonuses, benefits costs, total official time hours, and those hours as a percentage of total hours worked; (4) total compensation paid for negotiating collective bargaining agreements or other employment matters, processing grievances, or engaging in mediation, arbitration, or impasse resolution; (5) total arbitrator fees for grievances; (6) total travel and lodging expenses for collective bargaining negotiations; (7) total expenses for experts in negotiations; (8) total expenses for factfinders, mediators, or arbitrators in disputes under agreements; (9) total hours of free or discounted agency property use by labor organizations or employees on official time; (10) square footage of real estate provided to labor organizations; (11) total monetary value of property uses, including maintenance and acquisition costs; (12) reimbursements collected for such uses; (13) total agency expenses for administrative support and technology for official time activities; (14) explanation of any increase in official time from the prior year; and (15) total penalties, arbitration awards, or settlements related to collective bargaining. This section further requires the Government Accountability Office (GAO) to audit agency accounting practices for these items at least every four years and, if an agency fails to use generally accepted accounting principles, to brief the relevant congressional committees.
