S. 1180 — Abolish TSA Act of 2025

This section defines key terms used in the Act, including "Administration" as the Transportation Security Administration, "Administrator" as the Administrator of the Transportation Security Administration, "appropriate congressional committees" as the Senate Committee on Homeland Security and Governmental Affairs, Senate Committee on Commerce, Science, and Transportation, House Committee on Homeland Security, and House Committee on Energy and Commerce, and "Secretary" as the Secretary of Homeland Security.

This section establishes the policy of the Secretary to (1) expeditiously eliminate or transfer all authorities, enforcement functions, and programs of the Administration (i.e., the Transportation Security Administration (TSA)); and (2) privatize all commercial airport security.

This section abolishes the Transportation Security Administration (TSA)—the Department of Homeland Security agency responsible for securing the nation's transportation systems, including airport passenger and baggage screening—and repeals all programs under its administration 3 years after enactment.

This section requires the Secretary of Homeland Security, in consultation with the Secretary of Transportation, to submit to Congress, not later than 90 days after enactment, a reorganization plan for the Transportation Security Administration (TSA) that includes the following: (1) establishment of the Office of Aviation Security Oversight within the Federal Aviation Administration (FAA), headed by a Director and responsible for oversight and regulation of aviation security activities under the private airport screening program (49 U.S.C. §44920)—which allows airports to contract with qualified private screening companies for passenger and property screening, subject to TSA approval—except that no office employee may conduct screening; (2) rapid transfer of all TSA aviation security activities and equipment to such private screening companies; (3) any necessary changes to the private screening program; (4) proportional reductions in TSA operations and personnel until the transfer is complete, with no TSA aviation security operations or personnel remaining; and (5) transfer to the Department of Transportation of TSA functions, personnel, assets, and liabilities related to surface transportation security (i.e., mass transit, freight rail, highway motor carriers, and pipelines). The plan excludes any requirements for private screeners to conduct warrantless searches or seizures and any extension of the deadline in section 4. This section further requires the Secretary to submit progress reports every 30 days, beginning 60 days after enactment, to the Comptroller General and appropriate congressional committees; and requires the Comptroller General to submit compliance reports to Congress every 180 days, beginning 180 days after enactment.

This section establishes expedited procedures for congressional consideration of a joint resolution approving the Secretary of Homeland Security's reorganization plan for the Transportation Security Administration (TSA), as submitted under section 5 of the Abolish TSA Act of 2025. The joint resolution must include a specific title and resolving clause with the submission date and a detailed plan description (including congressional amendments); it is to be introduced in either chamber on the first session day after transmittal. In the House of Representatives, the resolution is referred to the Committee on Homeland Security and, if not reported within 75 continuous session days, is discharged for floor consideration. In the Senate, it is referred to the Committee on Commerce, Science, and Transportation and, if not reported within 75 continuous session days, is discharged and placed on the calendar; floor proceedings waive points of order, limit debate on motions to proceed, and restrict veto message debate to 10 hours equally divided between party leaders. For a resolution received from the other chamber, each house applies fast-track rules including committee discharge after 5 legislative days (House) or no referral (Senate if identical), non-debatable motions to proceed after 3 legislative days (House), waivers of points of order, and 2 hours of debate equally divided before final passage (House). (Thus, the procedures ensure prompt review and vote on TSA reorganization approval with minimal delays or amendments.)
