S. 1202 — Hot Foods Act of 2025

This section revises the definition of eligible food under the Supplemental Nutrition Assistance Program (SNAP) to include hot foods or hot food products ready for immediate consumption (previously excluded except as authorized in specified clauses) and to exclude only alcoholic beverages and tobacco. It also (1) modifies SNAP retailer disqualification criteria in subsection (o)(1) by permitting stores offering such foods for home or immediate consumption where not more than 50 percent of total gross sales are from hot foods; and (2) expands allowable items in co-located accessory food service facilities under subsection (q)(2) to include hot foods. (Thus, SNAP households may use benefits to purchase hot prepared foods at qualifying retailers.)
