This section prohibits the head of an executive agency from entering into a contract for the procurement of goods or services with any person determined, with the concurrence of the Secretary of State, to knowingly engage in significant business operations with an authority of the Government of Venezuela not recognized as the legitimate Government of Venezuela by the United States (i.e., the Maduro regime). Exceptions apply to (1) contracts determined by the Secretary of State to be necessary for humanitarian assistance to Venezuelans, disaster relief, noncombatant evacuations, or U.S. national security interests (with notification to specified congressional committees); (2) contracts supporting U.S. government activities in Venezuela (including maintenance of U.S. facilities) or with international organizations; (3) persons with a valid license from the Office of Foreign Assets Control to operate in Venezuela; and (4) contracts related to operation and maintenance of U.S. consular offices and diplomatic posts in Venezuela. The Secretary of State may waive the prohibition if determined to be in the U.S. national interest, and the prohibition applies to contracts entered into during the three-year period beginning on the date of enactment.
