S. 1236 — FISCAL Act

This section revises milk requirements under the National School Lunch Program by requiring schools to offer students a variety of milk, including fluid milk and plant-based milk, consistent with the Dietary Guidelines for Americans or, if plant-based milk is not covered by the guidelines, nutritional standards established by the Secretary of Agriculture (from fluid milk only). It eliminates the requirement to provide fluid milk substitutes specifically for students whose disability restricts their diet upon a licensed physician's written statement; retains authority for schools to substitute nutritionally equivalent nondairy beverages (fortified with calcium, protein, vitamin A, and vitamin D to levels in cow's milk) for fluid or plant-based milk to accommodate medical or other special dietary needs upon written request from a medical authority or parent or guardian, with notice to the state agency; and makes conforming amendments to related program provisions.
