This section states six congressional findings concerning constitutional authority over elections, the National Voter Registration Act of 1993 (NVRA), the Help America Vote Act of 2002 (HAVA), and Executive Order 14248. Specifically, the findings are that (1) Article I, Section 4 of the Constitution assigns authority over the time, place, and manner of elections to Congress and the states, not the President; (2) President Clinton signed the NVRA (P.L. 103-31) on May 20, 1993, with bipartisan support; (3) the NVRA establishes voter registration requirements without mandating documentary proof of citizenship on the National Mail Voter Registration Form; (4) President Bush signed the HAVA (P.L. 107-252) on October 29, 2002, on an overwhelmingly bipartisan basis; (5) the HAVA established the bipartisan Election Assistance Commission to assist states with election administration standards; and (6) Executive Order 14248, issued by President Trump on March 25, 2025, exceeds executive authority, is illegal and unconstitutional, and would disenfranchise millions of voters.
This section prohibits the use of federal funds by the Department of Government Efficiency to access each state's voter registration lists, records concerning voter list maintenance activities, federal immigration databases, or other public or private state records related to federal elections.
