S. 1270 — Consensual Donation and Research Integrity Act of 2025

This section establishes registration, inspection, recordkeeping, labeling, and packaging requirements under a new section 373A of the Public Health Service Act for persons who acquire human bodies or body parts and sell them for profit in or affecting interstate commerce, if donated or transferred for education, research, or advancement of medical, dental, or mortuary science (not human transplantation). Exceptions apply to the Organ Procurement and Transplantation Network, its members, funeral service professionals regarding preparation and disposition, and schools of medicine, dentistry, mortuary science, and certain research or training entities that do not sell for profit. (1) Registration requires an application to the Secretary of Health and Human Services with specified information (e.g., business names and addresses, premises description, compliance assurances), fees based on implementation costs (available per appropriations Acts), periodic renewal, and notification of changes within 30 days. (2) The Secretary inspects registrant premises at regular intervals. (3) Registrants must maintain records for each acquisition or transfer, including donor consent documentation (per applicable laws), medical history, chain of custody, and disposition details. (4) Registrants must label and package bodies or parts and maintain chain of custody per Secretary requirements.
