S. 1292 — Save Our Seafood Act

This section exempts from the annual numerical limitation on H-2B nonimmigrant visas (i.e., 66,000 for temporary nonagricultural workers) any alien employed (or offered employment) as a fish roe processor, fish roe technician, supervisor of fish roe processing, or fish processor, as defined to include persons processing fresh or saltwater finfish, mollusks, crustaceans, or other aquatic life (other than marine mammals or birds) through activities such as handling, eviscerating, freezing, packing, or labeling (but excluding harvesting, transport without processing, or retail). (Thus, employers may hire an uncapped number of such H-2B workers when U.S. workers are unavailable.) The section also repeals a prior temporary exemption for fish roe processors in sec. 14006 of the Department of Defense Appropriations Act, 2005.
