This section revises foreign gift disclosure requirements under section 117 of the Higher Education Act of 1965 (20 U.S.C. 1011f) for institutions of higher education (i.e., those owned or controlled by a foreign source or receiving gifts from or contracts with a foreign source). Specifically, it (1) lowers the semi-annual reporting threshold to any value (from $250,000), considered alone or in combination within a calendar year, for foreign sources associated with a covered nation (defined by reference to 10 U.S.C. 4872(f)(2)), while retaining the $250,000 threshold for other foreign sources; (2) requires the Secretary of Education to transmit copies of all such reports, documents, or records to the FBI Director and Director of National Intelligence within 10 days of receipt; and (3) directs the Secretary to transmit all existing reports, documents, records, and investigation materials received or generated under the section—regardless of date or case status—to the FBI Director and Director of National Intelligence within 90 days of enactment. (Thus, institutions must disclose all gifts and contracts from covered nation-associated sources, expanding reporting beyond prior dollar thresholds.)
