S. 1348 — Fairness for Stay-at-Home Parents Act

This section expands the exceptions to an employer's recovery of health insurance premiums paid to maintain group health coverage during Family and Medical Leave Act (FMLA) leave when the employee does not return to work, by adding the birth of a son or daughter as a qualifying reason (i.e., previously limited to the employee's serious health condition or circumstances beyond the employee's control). (Thus, employers may not recover such premiums paid on behalf of an employee who fails to return due to the birth.) It further requires employers to notify eligible employees taking FMLA leave for the birth of a son or daughter of this non-recovery protection.
