This section establishes a property right in an individual's voice or visual likeness—held by the individual or right holder (i.e., licensee, heir, or assignee)—to authorize its use in a digital replica (i.e., computer-generated, realistic electronic representation where the individual did not perform or appear, or where the original performance or appearance is materially altered) or in products/services requiring such authorization to avoid liability. The right is not assignable during the individual's life but is licensable (exclusively or non-exclusively); perpetual regardless of commercial exploitation during life; transferable by will, intestate succession, or other conveyance after death; and exclusive to the individual (during life) or right holder (after death). The section also defines related terms, including digital fingerprint, interactive computer service, online service (e.g., websites providing public access to user-uploaded material, including certain digital music providers under 17 U.S.C. §115), sound recording artist, and user-uploaded material.
