S. 1384 — Abortion Funding Awareness Act of 2025

This section requires states that make Medicaid payments from federal funds (i.e., payments eligible for federal financial participation under Title XIX of the Social Security Act) to abortion providers during a fiscal year—beginning with the first fiscal year ending after enactment—to submit a report to the Secretary of Health and Human Services not later than 60 days after the fiscal year ends and to publish the report on the state's public website. The report must specify, for each such payment, (1) the amount and purposes of the payment, (2) a comparison of the amount to any prior fiscal year payment to that provider, (3) the number of abortions performed by the provider that fiscal year, (4) the gestational age of each such abortion, and (5) the method of abortion used ("abortion" defined to include intentionally killing an unborn child or terminating a known pregnancy, other than to produce a live birth after viability or remove a dead unborn child; "abortion provider" defined as an entity that performs or refers abortions or is controlled by, controls, or is under common control with such an entity). Not later than 90 days after the fiscal year ends, the Secretary must submit the state reports to the House Energy and Commerce Committee and Senate Finance Committee, include a summary of the reports, and publish them on the HHS public website. This section amends Medicaid state plan requirements (42 U.S.C. 1396a(a)) by adding paragraph (88) to incorporate these reporting obligations.
