S. 1465 — Credit Access and Inclusion Act of 2025

This section amends Section 623 of the Fair Credit Reporting Act (FCRA) to permit landlords and utility or telecommunication firms—including energy utility firms providing gas or electric services—to furnish consumer payment information (positive or otherwise) to consumer reporting agencies (CRAs), including for (1) lease agreements on dwellings (including those with HUD-subsidized payments) and (2) utility or telecommunication service contracts, subject to a limitation that utility/telecommunication usage data may be reported only as it relates to payments or service terms (e.g., deposits, discounts, or conditions for interruption/termination). (Thus, energy utility firms may not report payment plan balances as late if the consumer is complying.) The section further limits furnisher liability under FCRA Section 623(c) for compliance with this new provision (including related regulations) and directs the Government Accountability Office (GAO) to report to Congress within two years of enactment on the consumer impacts of such reporting.
