S. 1468 — A bill to amend the Alaska Native Claims Settlement Act to provide that Alexander Creek, Incorporated, is recognized as a Village Corporation under that Act, and for other purposes.

This section recognizes Alexander Creek, Incorporated as a Village Corporation and Alexander Creek village (in T. 15 N., R. 7 W., Seward Meridian, Alaska) as a Native village under the Alaska Native Claims Settlement Act (ANCSA; 43 U.S.C. 1601 et seq.), notwithstanding the deadline in ANCSA section 11(b)(3) and Alaska National Interest Lands Conservation Act section 1432(d). (1) Requires Alexander Creek, Incorporated to submit corporate charter amendments converting it from a Group Corporation (for Alaska Natives without village enrollment) to a Village Corporation, and fulfilling terms of a claims settlement agreement. (2) Directs the Secretary of the Interior to initiate negotiations within 30 days of enactment for an agreement, due within 13 months, settling Alexander Creek's aboriginal land claims and other claims against the United States at approximate parity value with similar Village Corporation agreements; authorizes coordination with the General Services Administration (GSA) for surplus federal real property transfers under that agreement, deems Alexander Creek a "State" and "State agency" under 40 U.S.C. 549(a)(2)-(3), and deems it eligible for surplus real property under 40 U.S.C. 1303 (governing assignment, lease, sale, or demolition of surplus federal real property outside the District of Columbia). (3) Requires notification to village members ceasing their at-large shareholder benefits from Cook Inlet Region, Incorporated (under ANCSA section 7(m)) with Alexander Creek retaining future resource payments (under ANCSA section 7(j)); immunizes the Region from related liability. (4) Specifies that the recognition does not reduce Alexander Creek's prior Group Corporation land entitlements or alter other Regional or Village Corporation land agreements.
