S. 1487 — LIABLE Act

This section establishes in 28 U.S.C. a terrorism exception to the jurisdictional immunity of international organizations (i.e., those granted immunity under the International Organizations Immunities Act, 22 U.S.C. 288 et seq., including their agencies and affiliates) in suits seeking money damages for personal injury or death caused by torture, extrajudicial killing, aircraft sabotage, hostage taking, or material support therefor, if committed by an official, employee, or agent acting within the scope of their office, employment, or agency. Courts must hear such claims if (1) the organization conspired with, materially supported, or aided and abetted a foreign terrorist organization designated under 8 U.S.C. 1189, and (2) the claimant or victim was a U.S. national, member of the armed forces, or U.S. government employee or contractor acting within scope at the time of the act, or the organization is based in or has substantial presence in the United States; actions must be commenced within 20 years of the cause of action arising. This section also makes a conforming amendment to the table of chapters for 28 U.S.C. part IV.
